Copyright wouldn't matter. Various foods, like cheese and chocolate, can't have those words as part of the name unless they meet a certain percentage of it in the product. Not enough cocoa in your chocolate? Can't have chocolate in the name. Chocolaty orange would be allowed though.

Hate to be the "actually" guy, but it's nitrogen inside. Air would turn them quickly while nitrogen helps them last longer without spoilage.

In the 70s the bags were filled to the tops and they were a combination of foil with paper lining. The chips were still fresh, less broken than now and better quality potatoes were used. Don't fall for that half a bag of whatever is used to inflate the chips are still broke to hell.

Air is ok but they are tricking and purposefully misleading the consumer with clear view on bottom and opaque at top to hide the empty area.

That actually only affects the chips breakage a minimal amount.

Actually someone conducted an experiment which showed that the more air in the bag, the more the chips will crumble during transport because they can move inside more. Look it up online

Oh, there's a bit more to it than that. I agree that some chip styles are more delicate than others. For instance, Fritos are packed in pretty tight because they are more sturdy. But it's also a very easy way to shrink the amount of contents without it being too obvious to the regular shopper.
