Sometimes the world, or rather the democratic world, makes little sense. It happened last year when in June the historic Roe v. Wade ruling was overturned after almost 50 years by the Supreme Court, making it illegal to get an abortion in many states.

Recently, Montenegro, one of Europe’s youngest, independent countries, baffled its citizens after a woman was fined for defending herself a bit too effectively against a man who had sexually assaulted her.

The 24-year-old student, Milica Živković, found herself in a distressing situation as she walked home with a friend after a night out in the town of Kolašin, located in northern Montenegro. They became aware that a man was trailing them closely.

Despite his attempts to engage them in conversation, the two friends opted to brush off his advances and respond with laughter. However, the situation then took a turn for the worse, resembling the dreaded scenario that many women and men alike hope to avoid.

    “He grabbed my chin… and then he grabbed me by my intimate part (bottom area),” Živković told Metro.

    She continued: “Defending myself, I hit him with a closed and then open fist, which I learnt while training kickboxing for four years.” After giving all the strength she got to fight back against her attacker, to her own surprise, Milica knocked him out.

    During the court proceedings, Milica was imposed with a fine of €82 for allegedly “exceeding the necessity of self-defense” and for purportedly “violating public order and peace.” These penalties left her feeling profoundly uneasy about the situation.

    Her assailant, however, was required to pay a mere €370 as a condition for his release from prison.

    In a display of solidarity with Milica, thousands of individuals, predominantly women, marched through major cities across the Balkan nation to protest against sexual violence.

    “I regret that such examples confirm how necessary we need changes in the judiciary and prosecutor’s office,” Dritan Abazović, the prime minister of Montenegro, said in his statement.

    “Milica was not afraid, but bravely and calmly defended herself from the bully, who eventually got the upper hand and was beaten.”

    Of course, the court’s verdict didn’t sit well with many, sparking a debate on country’s laws

    Following news of the court’s verdict last week, hundreds of individuals, mostly women, came forward, offering to cover Milica’s fine. She has since filed an appeal against the judgment, not primarily due to the monetary aspect, but with the aim of upholding justice.

    The student said that most people were very supportive of her situation with the exception of some women who showered her with negative comments.

    The online community was just as baffled by this development as the citizens of Montenegro

    This is utterly ridiculous. Everybody knows what would have happened if she didn't do anything. She would have most likely been räped and maybe even kïlled. This state of mind of the judge (and I'm afraid not just the judge) is the reason women are still seen as less than men. I'm happy she knocked him out. She should have kicked him in the fücking nuts.

    I think if you are committing a serious crime such as rape against someone you should be considered fair game. Whatever happens is a consequence of your actions not the victims.

    The judge deserves to be taken out of office and punished for what is obviously a denial of justice. He probably wouldn't have done the same if the assaulted woman was his wife or daughter...

    The real question here is whether this judge was just a regular misogynist or whether in addition to that the country lacks proper laws to punish such sexual assault. Quite a lot of places only have laws against rape, not groping and fondling, so the latter isn't punishable. Since she defended herself so well, there might actually be nothing even a sensible judge could convict him of? The article totally lacks that kind of background information.

    It's not the judge. In many countries the law says that self-defence has to be "proportionate" - for instance, if someone grabs your arm, you can't chainsaw their legs off. The judge is applying the law made by the Montengran legislature. They're the ones who need to buck their f*****g ideas up.

    She shouldn’t have said she practiced kickboxing. A boxer friend almost went to jail because he punched a man who was trying to steal an old lady’s bag. as he does boxing, his fists are considered weapons that is supposed to master. ridiculous. the judge even have the guts to told him "you should have hit him with your feet"

    She did not continue to beat him after he was unconscious. She did what she had to to protect herself. Plus adrenaline is a real thing in a situation like that. I agree with this kind of ruling for protecting property, but your physical person is different. Women already are told they have to be careful how they turn down men, now they have to be careful how they defend their bodies?!

    Such nonsense is unfortunately more common than we might think. Some years ago a guy fought a burglar that had broken into his house at night, and wounded him severely. The burglar sued the man for "fighting disproportionately", or smth. like that. He was eventually cleared, but he went through hell just because he defended his wife, his child, and his property.

    I hope everyone involved in that decision burns on hell. I hope she finds the guy who assaulted her, kicks his a*s and tells the cops, here is your $30. So a woman can defend herself as long as she doesn’t make the man look weak. If she fights back and he stops his assault because it’s taking too much time or people might hear, that’s ok. If a woman cannot assault him in return; she is emasculating him. And that is wrong.

    Unfortunately Canada is the same way. If it's determined you used more force than is deemed necessary to defend yourself, you're going to jail. God forbid you use an object in your house to fight off someone who broke in and it turns out they didn't have a weapon themselves! Jail. The criminals in Canada have more rights than the victims.

    Are you freaking kidding??? No way this girl should be charged with anything and fined for it. I had my son's in Taekwondo for self defense that has paid off a couple of f times. Their instructor was a neighbor when we were kids and told us 1 night in class about a petite girl that we watched her black belt test a few mos before was at a lake with a friends family. She went to the bathroom and SCREAMED, people came running but it was 2 late she reacted with her training and put that a*****e in a hospital. Turns out he was a convicted sex offender. She called Mike scared that she would be charged with something, no you won't, you did what you were trained to do. I'm 5' 5" and taller than her so imagine this little petite 16 yo kicking that creeps a*s.

    Unfortunately in my experience as someone living in America, our legal system isn't much better. I reported being raped, and the police officers not only treated me like I didn't matter, but they also Baker Acted me. All the people at that facility said I shouldn't have been there, and should sue them. The police treated me like I was the criminal! (In Florida, there's a law that allows police to detain someone and put them on a psychiatric hold.) But they abuse that law and uphold it incorrectly.

    Ummm…fact check your opening statement there. Overturning Roe v Wade did not make abortion illegal in any states. It’s simply gave the states the right to decide for themselves, and several states chose to make it illegal. The Supreme Court had nothing to do with determining, where it would or would not be illegal. People really need to understand that concept, it’s your state you need to be upset with, and you need to be voting if you disagree with their decision. Being upset with the supreme court does nothing.

    Are you freaking kidding??? No way this girl should be charged with anything and fined for it. I had my son's in Taekwondo for self defense that has paid off a couple of f times. Their instructor was a neighbor when we were kids and told us 1 night in class about a petite girl that we watched her black belt test a few mos before was at a lake with a friends family. She went to the bathroom and SCREAMED, people came running but it was 2 late she reacted with her training and put that a*****e in a hospital. Turns out he was a convicted sex offender. She called Mike scared that she would be charged with something, no you won't, you did what you were trained to do. I'm 5' 5" and taller than her so imagine this little petite 16 yo kicking that creeps a*s.

    As soon as I saw the title i knew this was either mine or one of neighbouring countries...I was right. That's why I keep saying how american legal system is superior to ours in many ways, but noone believes me😅

    Unfortunately in my experience as someone living in America, our legal system isn't much better. I reported being raped, and the police officers not only treated me like I didn't matter, but they also Baker Acted me. All the people at that facility said I shouldn't have been there, and should sue them. The police treated me like I was the criminal! (In Florida, there's a law that allows police to detain someone and put them on a psychiatric hold.) But they abuse that law and uphold it incorrectly.

    Tom James is a moron. UK self defence law does not protect the criminal. And I'm loving all these people whining about the judge as though the judge makes laws up himself instead of following regulations and guidelines laid down by the Montenegran legislature...

    Ummm…fact check your opening statement there. Overturning Roe v Wade did not make abortion illegal in any states. It’s simply gave the states the right to decide for themselves, and several states chose to make it illegal. The Supreme Court had nothing to do with determining, where it would or would not be illegal. People really need to understand that concept, it’s your state you need to be upset with, and you need to be voting if you disagree with their decision. Being upset with the supreme court does nothing.
