Thanks to the internet it's never been easier for people to rip off something that somebody else created and pass it off as their own. It isn't just individuals who do it either, but major well-known companies like New Look, Forever21, and even Disney. We wrote about one such case before, where artist Tuesday Bassen discovered that Spanish retailer Zara had stolen her designs and were using them without crediting her, and now Bored Panda has compiled an extended list of people who have experienced similar unfair treatment at the hands of people too lazy, or too talentless, to create something for themselves. I would expect them to quickly offer a settlement once they realize they won't get away with it. Especially if you make more noise with local media etc.

Where did you find that bag and are you SURE that Disney crafted it? There's a good chance it's a knock off company. PS, I googled "Disney Alice in Wonderland cosmetic bag" and not one image of that bag showed up anywhere.

Considering how quick Disney are to bring aggressive legal action against the smallest, most remote, business producing an item with an unlicensed Disney image, this behaviour is doubly reprehensible. I hope that she does seek legal advice because she does have rights.

    The painting you've linked to, and the one in this post, are completely different though. The only way they're similar is that they contain Frieda Kahlo! Whereas the two in the post are practically identical, in terms of style, colour, and everything else except the flowers.

    By law "Cease and Desist" letters hold a great deal of weight and she sounds scared since she told you, you should "keep quiet". You can download a sample off of the internet and publish on your site that it was sent to her. Good for you in publishing her response to you! Many artists don't realize the power they DO have and it is letting people get away with it that hinders the possibility of protections for others.

    It is never a question of "needing" or not it is alway's a Cost/profit calculations. Same as the right price for a product is one the customer is willing to pay. Not the cost + a small margin. They probably still have an entire design team. But it still saves them designers and time to steal stuff.

    The funny thing is that everything Tuesday Bassen has here, isn't their original work either. These are pretty common ideas that have been done over and over again, over the years. You can't actually claim that this is your original work when it isn't original in the first place.

    It's ridiculously expensive to sue someone much less an entire corporation. Your best bet would be to take this and share share share on as many social media sites as possible. Get others to share it and try your damndest to make it go as viral as possible. If you can do that, you might just be able to get enough people making enough noise to catch their attention. Maybe then they'll at least compensate you in some way for the use of your work. And even if you do decide to go the hire a lawyer and suing route, I would still do what I suggested about making it go as viral as you can. Get enough people's attention and it should be easier to get the companies attention.

    I have a Facebook friend who had a Youtube video hijacked and used by a company without ant permission. It's cost my friend thousands and the company that stole it is doing all kinds of excuses not to pay him. The video was a personal one of his wife seeing their daughter off on her first day of school.

    Working in advertising, I have to say that unfortunately, most of the time, the clients don't have any idea where the artwork comes from, it's the ad agency or the graphic designers who stole it or are too lazy to produce real work...

    I guarantee Ford management does not condone the stealing of the artwork. They know the cost-benefit analysis is absolutely not worth it. This is the result of sloppy oversight from the people who created the ad. Heads roll over this type of thing because Ford does not want potential nationwide bad press over artwork that's worth a few hundred to a few thousand.

    I've actually noticed that this happens a LOT on etsy for some reason. I mean, a LOT LOT. They really need to crack down on this s**t. They do it because they think they can get away with it without consequences. Perhaps if they started shutting folks down/banning people and threatening legal action against those that steal artwork and try to pass it as their own, they might stop feeling so confident about attempting it. Cuz as of right now, people think nothing of doing it.

    I'm a HUGE fan of the popular K-pop group Stray Kids (their music is INCREDIBLE; they're not so big in Korea, because their music is much more hip-hop/rock influenced than most K-pop; if anyone wants a couple song recommendations, DM me!!!) and unfortunately finding items that are actually original is a needle in a haystack; it took my 9 PAGES of looking to find something original (handmade reproductions of earrings worn by my favorite member), and they're always copying each other.

    Don't downvote Angela, I know about one type of art theft being sold on Amazon and people from Amazon said that it wasn't their fault and they can't do anything about it. It's a loop so the artists that have been robbed of their artworks can mostly never end up getting back what they deserve :(

    That's Briana Garcia, she works for Disney. I've been following her work for years and she's fantastic. She started in Disneyland and has worked her way into their artist showcases and character drawing demonstrations. She is very talented. Her sketches and illustrations are 100% her property and do not belong to disney or the public unless she expressly says so. Regardless of the subject. If i draw Disney's cinderella, that is 100% MY work. Credit to Disney for their character but MY illustration. If i take YOUR illustration of disney's cinderella and claim it as my own then i am stealing YOUR work. If i take your illustration and try to sell it, i'm putting myself at legal risk for stealing both IP's because i did not make the drawing and do not have permission to sell it as my own goods and i do not have permission to profit from the selling of a copyrighted disney character.

    It isn't an issue if they aren't selling it. She may not have created the concept but she drew those images so they belong to her. Disney will not care that people are drawing their very loved characters. It is free advertisement after all... Selling it on the other hand may cause a little more trouble...

    okay, so I have always hated "Zara"....for me they have the ugliest and most overpriced clothes EVER (at least in my country....and at least in the women part)...sorry, but I am happy to find one more reason to dislike them :D Apart from that emotional outburst on my side, I m pretty sure they have enough money to get good designers work for them and not have to steal other people's work....or they could at least contact the artists and give them credits and money for their talent they later use to make even more money......

    I wonder if this company has an official license agreement with Disney and or Tim Burton and if they're allowed to use fan art based on their licensed intellectual properties. I'd have to brush on my character copyright knowledge to see if you'd even have a leg to stand on in chasing them up. You'd be better off asking Disney if they approved this, and then see what their take on it is. I do wonder if companies are allowed to take fan art based off their licensed characters without paying the fan artist.

    Actually I once had a Problem like that. I briefed a Photographer abrought for a project and sent an image as example of the mood wich i wrote next to the image. What I got back was an exact reshoot of the photo I sent... sometimes things like that happen

    Normally I would dismiss this complaint - after all, no one has copyright in a human pose - but what convinced me of the copying was that even the 'ratio' of the girl's legs in the photo to the background are almost identical. I'm not sure what the correct term for the 'ratio' is.

    The original is much nicer anyway. I LOVE the muscle and tendon definition in it. It shows the power and beauty of the human body. The imitation smoothed those all away and made the model's legs look like plastic.

    This would make an interesting court case. The recreation is not the original artwork, clearly, but the concept is exactly the same, from figures, to clothes, down to the masks (not the coloring) and the body poses. The derivative work is much nicer, but it's a stolen concept.

    I’m not saying this wasn’t an appropriation, but a lot of modern pop art uses the base of other popular images to create dialogue or commentary. Mixed media pieces like this might have many layers to the statement the creator is trying to make, this one using several. This is very different than someone who is lifting an image and calling it their own or trying to resell something that doesn’t belong to them. In many cases the pop artist will credit the original artwork and artists in it’s use. Real artists want to express themselves in their own words and work.

    I like Richard Prince. During the last 40 years, he has photographed, copied, and manipulated art, multimedia and advertisements in the name of appropriation, and provocation. He takes images out of their original context and shows them to us in a new light. Copyright laws have a lot of grey areas, and Richard Prince is lifting the veil for the world to see. In that sense, By using the works of other artists, he's the Duchamp of our time. Many people have filed lawsuits against him, and sometimes he wins and sometimes he loses. If I had made any of these portraits or selfies, I would be proud. It would group me with Cindy Sherman, Willem de Koenig and Warhol. Being copied by Richard Prince is a stamp of approval. It's something that you can show to a gallery owner and say: "Hey, look at this, Richard Prince noticed me. I'm THAT good, and you can now charge the same for one of my pieces, as you can for a Birkin bag!"

    Making "Fanart" is different than "Copying". Art from copyrighted characters is considered the artist's private art, but the distribution or selling of fanart based on copyrighted characters is considered stealing (in terms of monetarily) and usually artists that have inspired art that want to produce it contact the studio that copyrighted the characters and work out arrangements to sell it. So, it's considered your own, because it's "inspired" but that you can't sell it without their consent.

    Art comes in many different forms. Meaning, art can be anything from manga to framed poodle barf splatters. It's just up to your taste of style but anything that is similar to expression or application of human creative skill and imagination, typically in a visual form such as painting or sculpture, producing works to be appreciated primarily for their beauty or emotional power (quoted directly from Google.com). Obviously you have horrible taste in just about everything, I mean stereotyping art that looks like a 10 year old's art??? Shallow much?     I agree. Many people, especially children and teenagers, copy artwork they admire as a way of increasing their skills. There is nothing wrong with that. And if they feel they've done a good job they'll be proud and show people. Acknowledging the original artist is a polite thing to do and good way to increase links in the community. That said I have no idea if the original artist has approached the copier, in a friendly manner, complemented their work and asked that in future they acknowledge who drew the original picture. If not then that should be the first step. If they have then they have a right to be annoyed. That said, it's not a legal manner unless they are profiting in someway from it or commiting fraud (e.g. getting into art school), just a matter of manners and decency.

    If they're not selling it and just showing off art they've used your art as reference from... I guess you could ask them to credit you. It's probably not going to get you very far though. Artists copy other artists to practice drawing all the time. It's a good copy, but if it's just some private drawing, consider it a good tribute that went uncredited.

    While there is a posterize filter, you would NOT get the kind of quality and detail in the 'stolen art' by just slapping it onto the original photo. The artist created the image using the pose as reference. Still should have gotten the artist's permission or at the very least credited them, but the process was not as simple as you're saying.

    This case is WAY more complicated than it appears here. First off Shepard got permission to use a photo that was nearly identical to this one. Second off the photographer wasn’t the slightest bit mad and actually befriended shepherd, it was the company he was working for that was super upset.

    Fan art is fine, though it cannot be sold. Stealing someone's creation of fan art is still stealing. Selling someone's stolen fan art is a great way to get them shut down because the owner of the IP will likely have more ability to take action than a fan.

    Well, it s complicated for tatoo. of course the Kshocks s one is gorgeous. But i can imagine that someone can t travel to get this tatoo and ask an other tatoo artist to make it... very common actually. A lot of tatoos are just copy of some design because the customers want it. What we need is a good tatoo artist who can do everything we ask. but asking them to copy some work can just have a very bas result on you at the end, it s a risk sinc everybody as skills in some styles or not... but i dont see the problem. If my tatoo artist dont see any problem to do a copyright caracter or drawing if i ask it... why should we be upset for that one. Should we jail all the tatoo artist who did a mickey on their customers. Wake up people. The customers ask and you just fulfill his wish.     A good tattoo artist won't copy another one's design. They may use elements of the design or do something similar, but they wouldn't make an exact copy.

    I don't want to agree with this. If the tattoo artist claims that it's his design in his shop then yes it would be wrong. There are a many people with the EXACT same tattoo cause they like it and would orefer the original work. But yea if the tattoo artist markets the original design as theirs then I believe its forgery. Just my opinion don't mean to start anything lol

    The original artist, kshocs, is a tattoo artist. So this isn't a case of someone taking another form of art and getting it tattooed, it's someone taking a tattoo artist's work and having it done by some other tattoo artist. It's doubly gross because of the person who requested it from another artist AND the artist who was willing to tattoo/copy someone else's work.

    The tattoo artists get money for the work and not for the pictures. he girl just saw a pretty picture on the internet and liked it for a tattoo. Maybe she just wanted to say that this is not from the tattoo studio catalog. So if you want to get Justin Bieber's face tattooed you need to ask him? This is not a commercial use of your pictures, you should not complain - it is not like you are losing money! You put your art on the web and of course, someone will like it.

    I have a whole folder full of stolen pinterest images of tattoos of my commercial Canada maple leaf souvenir images. An embarrassment to the victims to know they are forever marked by a stolen commercial souvenir design.

    It's sad how few people understand intellectual property law and ethics. Especially bizarre that people seem to excuse it when it's a tattoo. Tattoos are not a free-for-all to steal artwork. No, an unapproved tattoo copy of someone's artwork is not flattery. It's theft. Flattery does not pay the bills. When the tattoo artist gets paid (knowingly or not) for copying someone else's art, that's an exchange of money for stolen art, and the artist is not getting that money (getting no compensation for their intellectual property being used/sold).
