Neighbor Advertises Access To Someone Else’s Property On A Paid Tour, Finds Out That Was A Mistake

Halloween decorations are a love language. The people who go all out with animatronics and carefully choreographed lighting displays are not just doing it for themselves. They are doing it for the people, for the craft, for the sheer joy of watching others stop and stare from the pavement. It is a generous impulse, and most neighbors appreciate it enormously.

One neighbor appreciated it so much that he built an entire paid walking tour around it, advertised it as an interactive photo experience, and invited twenty paying customers into the front garden of a man who had agreed to none of that. The moment the homeowner came outside and saw strangers sitting on his front steps, the decision he made was both swift and extremely satisfying to read about.

Halloween is all about the creepy stuff, but few things are as creepy as walking out to a bunch of strangers on your porch

When a neighbor agreed that his house could be part of a decoration tour, he meant for viewing from the pavement only

But when he came outside, he found that the people on the tour were posing for pictures on his front porch and all over his yard

The man simply switched off his decorations, forcing the people to leave without any further discussion

Property law is pretty clear on this one. A homeowner’s front garden, steps, and yard are private property regardless of how festive they look, and an invitation to view something from the pavement is not the same as an invitation to enter, touch, or pose with it. The legal concept of implied license, which is the informal permission granted when you allow people onto your property for a specific purpose, extends only to the purpose agreed upon.

Looking from the sidewalk and wandering around posing with animatronics are two meaningfully different activities, and the neighbor’s decision to expand the scope of the arrangement without discussion was not a minor administrative oversight. The neighbor turned this yard into a business opportunity, and that was creepy and kooky.

Research on negotiation and social contracts consistently shows that people tend to expand the boundaries of what was agreed upon gradually and often unconsciously, particularly when the original agreement was vague and verbal. It is called a creeping commitment, which is very appropriate in this setting.

The neighbor almost certainly did not see himself as doing anything wrong. He had permission, the decorations were spectacular, and his customers were going to love it. The problem is that permission for one thing is not permission for everything adjacent to that thing, and the gap between what was agreed and what was delivered to twenty paying customers was significant enough to end a tour mid-show.

There is also the small matter of liability, which nobody in this story appears to have thought about until now. Animatronics move. Fog machines reduce visibility. Halloween displays are specifically designed to be startling, disorienting, and generally hazardous to anyone not paying attention to where they are walking.

If one of those twenty tourists had tripped over a fake gravestone, sat on a motion-activated skeleton, or walked face-first into the fog machine, the resulting injury claim would have been covered by the homeowner’s insurance, not the neighbor’s tour business. Inviting paying customers onto someone else’s property without their knowledge is a liability issue dressed up in a ghost costume, and pulling the plug was arguably the most sensible legal decision made that entire evening.

Commenters found it weird that people would even pay for this, but also agreed that having strangers in your yard is a huge liability issue

Nah, OP was right to shut that down. HUGE difference between taking pix for the sidewalk vs. interacting directly with the decorations.

And shutting it down showed that tour guide that he was serious and would take the needed steps.

Oh it's the old 'You should have handled it in a way I could ignore' complaint. OP is of course correct in what he did. Had he used the garden hose to drive them off his property, that might be excessive. What he did was just right.
