There are few things more dangerous than giving someone a clipboard, a rulebook, and the authority to tell everyone else what they’re doing wrong. Because from that moment on, nothing you will ever do in their sight makes sense anymore.

That was essentially life in today’s Original Poster’s (OP) community, where an HOA president’s solution for every perceived violation was another fine. However, what began as irritating HOA enforcement eventually became much more serious when residents started questioning why their dues kept rising, and where the extra money was actually going.

    After retiring for the second time, the OP got into property management and purchased a luxury home specifically to rent it out. However, they quickly discovered that the neighborhood’s Homeowners Association (HOA) came with plenty of complications. One lady in particular had a reputation for finding violations everywhere and would fine residents for just about anything.

    One day, the OP was spending time with their tenants, who were also friends, and they had music playing. The difficult lady arrived, demanded that the music be turned down, and eventually fined the OP. However, rather than simply paying it, the OP challenged the penalty before the HOA board, and won. Now, that victory marked the beginning of a much larger feud.

    The difficult lady began scrutinizing both the OP’s property and the tenants, and so one day, the OP decided to meet with the tenants to discuss what was going on. That evening, they saw the difficult lady embracing a man who wasn’t her husband. They suspected she was having an affair and decided to tell her husband, and they divorced months after.

    The divorce left the lady financially suffering, and the fines didn’t stop. At some point, residents were reportedly fed up. The fines had become increasingly obscure and they also learned that the HOA budget had increased by about 15%. The lady defended the increase by saying the community needed money for repairs and that residents should have noticed the changes in the annual budget information.

    However, residents couldn’t help but wonder where their money was actually going. When they asked the lady about this, and she avoided them, they had no choice but to file a joint lawsuit seeking information about the HOA’s finances. Several months later, they found out that she had been living off the people’s fines and dues. This discovery then led to her arrest and charge of fraud and extortion.

    Homeowners associations can impose fines for rule violations, but their authority is generally limited by the community’s governing documents and applicable state laws, according to Nolo. Enforcement should also involve a fair process, including notifying homeowners about alleged violations and giving them an opportunity to respond or appeal.

    The financial side of the story raises a different, but equally important, issue. HOA Reserves notes that an increase in HOA dues isn’t automatically suspicious, as communities may need additional money for maintenance, repairs, insurance, or future reserve funding. However, HOA boards also have financial responsibilities to the communities they oversee, so transparency matters most when assessments increase.

    Homeowners should generally have reasonable access to information such as budgets, financial statements, reserve details, and meeting minutes. FirstService Residential then suggests that strong internal controls can help protect HOA funds from misuse. When too much financial control is concentrated in one person’s hands without adequate review, opportunities for misconduct can increase.

    Measures such as requiring multiple signatures for certain withdrawals, keeping reserve accounts properly safeguarded, and having financial statements independently reviewed can create additional layers of accountability.

    We had a similar problem - he HOA president and his mom living on HOA funds - until they decided to expand and tried to tell us that we, too belonged to the HOA. Turns out there was no HOA. We"re all testifying at the inc9me tax and fraud trials now.
