The difficult lady arrived, demanded that the music be turned down, and eventually fined the OP. However, rather than simply paying it, the OP challenged the penalty before the HOA board, and won. Now, that victory marked the beginning of a much larger feud.

The difficult lady began scrutinizing both the OP’s property and the tenants, and so one day, the OP decided to meet with the tenants to discuss what was going on. That evening, they saw the difficult lady embracing a man who wasn’t her husband. They suspected she was having an affair and decided to tell her husband, and they divorced months after.

The divorce left the lady financially suffering, and the fines didn’t stop. At some point, residents were reportedly fed up. The fines had become increasingly obscure and they also learned that the HOA budget had increased by about 15%. The lady defended the increase by saying the community needed money for repairs and that residents should have noticed the changes in the annual budget information.

However, residents couldn’t help but wonder where their money was actually going. When they asked the lady about this, and she avoided them, they had no choice but to file a joint lawsuit seeking information about the HOA’s finances. Several months later, they found out that she had been living off the people’s fines and dues. This discovery then led to her arrest and charge of fraud and extortion.

Homeowners associations can impose fines for rule violations, but their authority is generally limited by the community’s governing documents and applicable state laws, according to Nolo. Enforcement should also involve a fair process, including notifying homeowners about alleged violations and giving them an opportunity to respond or appeal.
