I never understood this mentality of "this is why you tip" vs. "this is why we deserve better wages". You keep making the customer the villain and not holding the establishment accountable for giving you a living wage. I'd pay more for food to not tip if that's the answer. When I travel out of this country, tipping isn't' even a thing, so why do we keep harping on it here as if our tips are the only reason you don't have a living wage.

The minimum wage isn't $2. Unfortunately, people that work for tips are exempt from min wage laws. If they make less than min after tips their employer are obligated to make up the difference, but they probably wouldn't do it more than once, if ever (depends on whether the employee knows they're owed). They'd probably be fired for being a bad waiter. Tip based pay is a terrible system. That said, a good waiter at a good restaurant can make bank (statistically more if they're also attractive).

It is a messed up system. If I go to breakfast place My bill is about 20+ for me and wife, plus $3 tip so I am spending 23. I go out for dinner and the bill is 40+ and the tip is $6. The servers at both places did the same job, Take drink order-bring drinks, take food order-bring food, come around and make sure you have everything you need. done. I don't believe tip should be based on cost of food when they do the same job, just bring different food.
Yup. Time of day and day of the week impact tips (how busy is it, folks don't order as much alcohol on a Tuesday as a Friday night). There's competition for the 'best' shifts which can add unpleasant compilation to the workplace dynamic, and always working evenings/weekends (because they tend to pay more) can be really hard on parents of young kids. It's a messy process. Fixed pay based on hours would work better for most people overall - but you'd have to build that into menu prices and do away with tipping. (Which is how plenty of countries do things, but change is hard for people.)

It is legal because that check doesn't account for her total income with the job. The US requires that a person make the standard minimum wage rate after all income - hourly salary and tips are calculated. If after those two amounts were combined she still didn't make standard minimum wage, the employer would be required to compensate her the difference. That her check was so low meant that she made enough tips to meet minimum wage. She didn't share the amount of her tips for a reason. People are outraged when they see someone making $9 for 70 hours worked, but not so outraged when she made at least $500.

Her pre-tax salary was $151 + $708 = $858, and she paid about 16% in taxes (a much lower tax rate than I pay). $2/hour is very low pay, but if her boss decided to increase wages by eliminating tipping, and raised her salary to $10/hour, she'd earn less than the $12/hour including tips she's earning now.

She "DECLARED" 703 dollars for a 70 hour. I work in the industry. I can guarantee you without reservation, that she only claims her Credit Card tips. She does not report her cash tips. NO SERVER DOES. That's one of the perks of being a server, its illegal, but they ALL do it. So she most likely made 2,000 for a two week period. Not a month. Articles like this frustrate me because it makes it seem like servers don't make at least minimum wage per pay period. Unless their employer is breaking federal law - they do. Federal minimum wage is $7.25/hr, but in DC a server will make $14/hr minimum. The Department of Labor requires that: If an employee’s tips combined with the employer’s direct wages of at least $2.13 an hour do not equal the minimum hourly wage, the employer must make up the difference.
The tips are not part of her salary, she could have made $10,000 in tips and still has the right to claim.
Ask any bartender if they would rather make $12 an hour or tipped wage plus tips and they are gonna say tips. If we suddenly abolished tipped wages in all states (CA doesn't have a tipped wage, so they get $12 an hour plus the food is more expensive and they still expect a 20% tip) people would go to better paying jobs and there would be a shortage of good employees. On top of your food being 30% more expensive.

If you want to tip because you had good, prompt, reliable service, you should. Your waitperson is only the frontline of what goes on in the kitchen. Timing is everything. There should be a living wage over tipping. It isn't "slave" wages. They worked for free. But it is sharecropper's wages and it's wrong.

I have a close friend who is a waitress and her checks look the same but that is because of all the deductions that come out of her check; Union dues, taxes, insurance, etc. I do agree that they SHOULD be paid more but let's put things in their right perspectives.
Did you miss the "This is why you tip" message? That's the whole point, that your tip is not a bonus for the server, it's the main source of income.

No lie, I got a statement that my pay was -$5.00 because they charged us about $15 for our employee discount, and I believe we got paid about $2.15 an hour (and were taxed on that). That’s all I have to say. You have no idea how it feels to work hard to not be a deadbeat and then realize you made nothing and you owe them unless it has happened to you. federal minimum wage for tipped employees is $2.13 per hour in the state of Virginia and in I believe 20 other states. That said, anyone working in these states should not expect a paycheck. The employer does have to compensate the difference if the they don't and if that server doesn't hit that mark they don't need to be a server. It long, hard work and the government/states should change the wages. My daughter lives in Manhattan. They pay their servers a living wage (LOL) BUT allows them to keep/claim tips when they are given. Servers in these states that follow the federal minimum wage for tipped employees @ $2.13 per hour definitely do not work for the paycheck!! Its a great lesson for those who were not aware.
Incorrect. Federal Minimum Wage is $7.25 per hour. It's the BASE rate because that is where the calculation for the Minimum Wage begins. Add in your tips to the BASE rate to get Fed Min Wage.

Anyone who has worked in the hospitality industry longer than a week knows you never even consider your paycheck. People want to b***h about fair wages, living wages. First, I've worked all front house restaurant positions, so I know that they are non-stop, fast paced, hard jobs, and that cash at the end of the night makes it all worth it, and a bad night in tips really sucks, and if those bad nights keep up then it's time to find another job. Second, as someone who no longer works food service, I really don't like tipping when I go out to eat because going out to eat is already expensive. I think that restaurants should pay their employees a living wage and a tip is for good service, not an obligation. $2 an hour is criminal. Dinning out is getting more and more expensive, and sometimes the cost of a not so great meal is way over priced, then you are obligated to tip. Customers pay for food. The business uses that money to cover everything, this includes wages - employees get paid. Employees sometimes get a bonus for working above and beyond. Now Businesses have caught onto that and factored tips in as wages. This would be ok if the food came down in price accordingly but it doesn't. Now... Customers pay for food, are pressured to 'tip' and the business laughs while we pay the company AND the employees wages for them. Once again, this WOULD be okay if the food lowered in price since we are paying extra and the business is not paying the employees but the food is still the same price. Ultimately, it's the same principle with feeding wild animals. It's ok while it lasts but when you stop they no longer rely on themselves and it all falls apart. This girl is like a baby bird getting angry at a human for not feeding it when really, it should be angry at it's parents.

So what would be a fair compromise here? If she was paid the minimum wage of $7.25 she would be making $514.75 for that 71 hours of writing things down, waiting for someone to stand in a hot kitchen preparing food for dozens of people, and than carrying it 50-100 feet to deliver it to a customer. That's before deductions. In order to pay food carriers that much, would mean raising prices of menu items. Which would cause customers to realize that they're paying more for the food to pay this servers salary, which means they are no longer motivated to tip at all. $2.13 x 71 = 151.23 + 708 = 859.23 / 71 = $12.10 per hour - deductions, leaves her with $10.10 per hour take home, and that's only what is unavoidable to report due to people applying a tip to their credit or debit card. No one reports untraceable cash gains, don't for a second pretend that this girl is any different. 15 years ago it was common to get 2-300 a night M-T and 500+ F/S/S. You pay them minimum wage, tips evaporate.
These people haven't been to the Philippines. $8 PER DAY for 8 hours worth of duty. Tips not allowed, or will be taken by the company. Walk away with a <$200 paycheck for the entire month's worth of work.

I knew something was wrong the minute I saw the headline. Notice she carefully didn't actually show the deductions for Medicare, SSN, and Federal taxes? I ran this through a paycheck calculator online that I use that is very reliable, using states that did not have state or other taxes (like SDI in CA where I live), Single and no allowances as she showed and those taxes would have been $12.01 (Fed: $0.47, SSN: $9.35, Medicare: $2.19) leaving her with $138.79. she got paid $150 for the 70 hours of work. blame the government for the deductions which brought her net pay to $9. restaurants pay a lower minimum wage because staff makes tips. the majority of restaurant workers dont declare their cash tips, only their credit card tips get declared for tax purposes.
I worked as a waitress for many years actually never got a paycheck but was making 300 to 400 a week in tips.I think the point here is not the paycheck but to remember to tip....
How is this legal?? Isn't htere a minimum wagee? tips should be a well deserved bonus. I work in tourism, do get tips and they are an important part of my income, but I don't LIVE of them. My basic pay is enough enough for basics, the tips ad the higher quality food, extras etc.
If that is what you are being paid for all those hours, then something must be seriously wrong with you if you are still there? It is not the customers' responsibility to pay your wages (via tips), but rather the business you work for, they make a lot of money in profits and you should be paid a fair wage. Anyone who does not value their time like this probably have self esteem issues. If you do not like your wage, get a different job or a different employer. I can't believe that !! In a rich country like USA, getting paid a bit more than 2 USD per hour is totally atrocious, a true brutality against any employee!!! It should not be legal to pay someone so little, regardless of tips. Also, just so you know, the government assumes you get tips and taxes you on assumed tips. If customers don't tip you, or under tip you, you still get taxed on what the government thinks you SHOULD have been tipped.
While I disagree with the system, it isn't their fault that the government exempts them from minimum wage requirements. They rely on tips for their livelihood. This is why I tip a minimum of 20% unless the service was god-awful - as in waiting 20 minutes for a drink refill at a low volume time. Last night I tipped 67% for amazing service. It was a $29.50 final bill and I left a $50 which isn't much in the grand scheme of things, but for that one hour we were there, she made more than me as a laboratory supervisor with 10 years of experience. I struggle for money too, but at least I have a steady amount going in every month. She doesn't have that reliability.

I work in customer service, do i deserve tips too since you are relying on your customers to pay your wages i should be doing the same, or any retail job. Minimum wage in Australia is $19.49. When I first started working in the mid 90s my wages fer $5.20 and hour at 15 years old. Again how anyone lives in the USA is beyond me!

It angers me to read comments dissing her because she made good tips—-that week. The week before or after might not be so good. Or it might be better. Thing is, you can’t depend on it, because it can vary widely, depending on the season, day of the week, holidays, events, or even the schedule your boss gives you (the lunchtime crowd doesn’t tip as well as the happy hour and dinner crowds do). So I’d advise anyone making a regular salary they can rely on to sit and have a good deep think about how they’d feel if the amount of their take home pay depended on the mercurial whims—-and the depth of the pockets—-of the eating/drinking/partying public.

Load More Replies...I'm not a CPA but none of that adds up. Subtract her $53 SS and $13 Medicare from her $150 gross pay and she'd have to have been taxed 50% federal income tax to only take home $9. I have never worked as a server or waitress, but I watch them working. I can't believe what they do or how fast they do it. I feel the same way about the cooks or chefs. It amazes me that they are physically able to do it and with a smile on their faces. I don't eat out a lot, but when I do I tip extremely well. They are killing it all day long and they still smile when they wait on you. That cannot be an easy job and they should get much better hourly wages! Rarely do I get a waitress that sucks, but if they do I still leave them a tip. I am appalled when I see $2.00 left as a tip after a nice meal. The minimum wage isn't $2. Unfortunately, people that work for tips are exempt from min wage laws. If they make less than min after tips their employer are obligated to make up the difference, but they probably wouldn't do it more than once, if ever (depends on whether the employee knows they're owed). They'd probably be fired for being a bad waiter. Tip based pay is a terrible system. That said, a good waiter at a good restaurant can make bank (statistically more if they're also attractive).

Yup. Time of day and day of the week impact tips (how busy is it, folks don't order as much alcohol on a Tuesday as a Friday night). There's competition for the 'best' shifts which can add unpleasant compilation to the workplace dynamic, and always working evenings/weekends (because they tend to pay more) can be really hard on parents of young kids. It's a messy process. Fixed pay based on hours would work better for most people overall - but you'd have to build that into menu prices and do away with tipping. (Which is how plenty of countries do things, but change is hard for people.)

It is legal because that check doesn't account for her total income with the job. The US requires that a person make the standard minimum wage rate after all income - hourly salary and tips are calculated. If after those two amounts were combined she still didn't make standard minimum wage, the employer would be required to compensate her the difference. That her check was so low meant that she made enough tips to meet minimum wage. She didn't share the amount of her tips for a reason. People are outraged when they see someone making $9 for 70 hours worked, but not so outraged when she made at least $500.

Articles like this frustrate me because it makes it seem like servers don't make at least minimum wage per pay period. Unless their employer is breaking federal law - they do. Federal minimum wage is $7.25/hr, but in DC a server will make $14/hr minimum. The Department of Labor requires that: If an employee’s tips combined with the employer’s direct wages of at least $2.13 an hour do not equal the minimum hourly wage, the employer must make up the difference.
The tips are not part of her salary, she could have made $10,000 in tips and still has the right to claim.
Ask any bartender if they would rather make $12 an hour or tipped wage plus tips and they are gonna say tips. If we suddenly abolished tipped wages in all states (CA doesn't have a tipped wage, so they get $12 an hour plus the food is more expensive and they still expect a 20% tip) people would go to better paying jobs and there would be a shortage of good employees. The employer does have to compensate the difference if the they don't and if that server doesn't hit that mark they don't need to be a server. It long, hard work and the government/states should change the wages. My daughter lives in Manhattan. They pay their servers a living wage (LOL) BUT allows them to keep/claim tips when they are given. Servers in these states that follow the federal minimum wage for tipped employees @ $2.13 per hour definitely do not work for the paycheck!! Its a great lesson for those who were not aware.

First, I've worked all front house restaurant positions, so I know that they are non-stop, fast paced, hard jobs, and that cash at the end of the night makes it all worth it, and a bad night in tips really sucks, and if those bad nights keep up then it's time to find another job. Customers pay for food. The business uses that money to cover everything, this includes wages - employees get paid. Employees sometimes get a bonus for working above and beyond. Now Businesses have caught onto that and factored tips in as wages. This would be ok if the food came down in price accordingly but it doesn't. Now... Customers pay for food, are pressured to 'tip' and the business laughs while we pay the company AND the employees wages for them. Once again, this WOULD be okay if the food lowered in price since we are paying extra and the business is not paying the employees but the food is still the same price. Ultimately, it's the same principle with feeding wild animals. It's ok while it lasts but when you stop they no longer rely on themselves and it all falls apart. This girl is like a baby bird getting angry at a human for not feeding it when really, it should be angry at it's parents.

If she was paid the minimum wage of $7.25 she would be making $514.75 for that 71 hours of writing things down, waiting for someone to stand in a hot kitchen preparing food for dozens of people, and than carrying it 50-100 feet to deliver it to a customer. That's before deductions. In order to pay food carriers that much, would mean raising prices of menu items. Which would cause customers to realize that they're paying more for the food to pay this servers salary, which means they are no longer motivated to tip at all. $2.13 x 71 = 151.23 + 708 = 859.23 / 71 = $12.10 per hour - deductions, leaves her with $10.10 per hour take home, and that's only what is unavoidable to report due to people applying a tip to their credit or debit card. No one reports untraceable cash gains, don't for a second pretend that this girl is any different. 15 years ago it was common to get 2-300 a night M-T and 500+ F/S/S. You pay them minimum wage, tips evaporate.

I ran this through a paycheck calculator online that I use that is very reliable, using states that did not have state or other taxes (like SDI in CA where I live), Single and no allowances as she showed and those taxes would have been $12.01 (Fed: $0.47, SSN: $9.35, Medicare: $2.19) leaving her with $138.79. It should not be legal to pay someone so little, regardless of tips. Also, just so you know, the government assumes you get tips and taxes you on assumed tips. If customers don't tip you, or under tip you, you still get taxed on what the government thinks you SHOULD have been tipped.
While I disagree with the system, it isn't their fault that the government exempts them from minimum wage requirements. They rely on tips for their livelihood. This is why I tip a minimum of 20% unless the service was god-awful - as in waiting 20 minutes for a drink refill at a low volume time. Last night I tipped 67% for amazing service. It was a $29.50 final bill and I left a $50 which isn't much in the grand scheme of things, but for that one hour we were there, she made more than me as a laboratory supervisor with 10 years of experience. I struggle for money too, but at least I have a steady amount going in every month. She doesn't have that reliability.

It angers me to read comments dissing her because she made good tips—-that week. The week before or after might not be so good. Or it might be better. Thing is, you can’t depend on it, because it can vary widely, depending on the season, day of the week, holidays, events, or even the schedule your boss gives you (the lunchtime crowd doesn’t tip as well as the happy hour and dinner crowds do). Load More Replies...This is why I tip generously, or at least try to. The overall minimum wage should be a living wage so people don't have to depend on tips to make ends meet. We are a sick society that gives the rich huge tax breaks while the working class - who make all that wealth possible - work harder and harder for less and less.

I have never worked as a server or waitress, but I watch them working. I can't believe what they do or how fast they do it. I feel the same way about the cooks or chefs. It amazes me that they are physically able to do it and with a smile on their faces. I don't eat out a lot, but when I do I tip extremely well. They are killing it all day long and they still smile when they wait on you. That cannot be an easy job and they should get much better hourly wages! Rarely do I get a waitress that sucks, but if they do I still leave them a tip. I am appalled when I see $2.00 left as a tip after a nice meal. They should be able to keep all of their tips for themselves, not be forced to split them with another worker. The business is should pay everyone for the work they do!
Her $$ averages to be 12.27 an hour BEFORE taxes, you all act like she's raking it in! FFS- make your own drinks, and food and stay the F home if you think you don't need to tip. Then whine all day and night about the single Mothers on welfare and the kids on medicaid.
Reality check, please (no pun intended). The federal minimum wage is $5.15 and the Texas minimum wage is $7.25, so how is this woman's employer getting away with paying $2.13 an hour?
