“Your Lunch Won’t Cost Me $500”: Boss Demands Employee Answer Phone While She’s Eating

We all go to work every day to, you know, work. But there are plenty of moments during the day when we should be allowed to get up, stretch our legs, take a walk for a few minutes to clear our heads and get some fresh air, make some coffee, and oh yes: eat lunch. No matter where you are working or who you are working for, you are entitled to eat during your shift, assuming it’s more than a few hours long. Aside from the fact that eating is a basic human need and employers should not be subjecting their workers to inhumane conditions, a healthy, happy and not hangry employee is going to yield the most productivity. 

Unfortunately, however, one woman recently learned  that her boss did not understand the value of lunch breaks whatsoever, so she decided that working for him was just not going to be worth it. Below, you can hear the full story of how Irian, or Irian28 on TikTok, recently quit her job, as well as read some of the replies from viewers who were left fuming. Technically speaking, in the United States, federal law does not require that employers provide lunch or coffee breaks. However, in most states, there are rules in place requiring that employees take a lunch break, typically after between 4-5 hours of a shift. While Irian might be working in a state that does not have specific legislation around meal times when working, I would guess that she probably signed some form of contract stating that she would have a lunch break during every shift. Expecting people to work for 8 hours at a time without a gap for a meal is inhumane, and I don’t know many people who would agree to those conditions. 

Irian also made it sound like this was never an issue when she worked with her boss’ daughter. Clearly, there was a precedent in place that she would receive a lunch break every day, and when she was not on her lunch, she would be answering phones and assisting clients. There must be a mutual understanding between bosses and employees that if the employer respects their workers’ breaks, the employees will also respect the time they are on the clock and focus on the tasks at hand.

Regardless of what the law mandates, Irian deserves to eat during the day. It should go without saying that all employees are entitled to breaks, but apparently this boss did not understand that workers will no longer stand for unfair treatment. I’m glad that Irian knew her worth and did not decide to stay in a toxic work environment, but it is frustrating to hear about yet another employer who thought he could simply take advantage of his workers. FYI, to anyone in California - what happened here is illegal. If you're interrupted to work during your lunch, you legally get to restart your lunch all over again. This restart does not have extra time taken out of your paycheck (e. If you're 15 minutes into your 30 minute lunch and are interrupted to work, you can restart your 30 minutes - your employer cannot take that extra time out of your paycheck). You can also restart as many times as you are interrupted. If are not able to restart your lunch, for whatever reason, or cannoy take a lunch at all, your employer must pay you 1 hour of overtime (even if your lunch was only going to be 30 minutes). Know your rights! Source: live in CA, and am a manager who trained on HR law by my company (who were smart to do this because they want to make sure I wouldn't be a bad manager who'd get them sued for unknowingly breaking labor laws).

It's illegal under federal law too, though for different reasons. If they are off the clock, they are not to be doing any work. You don't have to give an unpaid lunch break (under federal law), but if you do, then like in California, it has to be a true break from work (including answering phones).

This is why workers are so frustrated!! One day I was running around, trying to do a bunch of things at once - wasn't even thinking, and I interrupted one of my staff member's lunch breaks. She patiently answered my questions, and then i realized/remembered she was on break! I felt so bad that I told her to clock back in and continue on her lunch break. How hard is it to show your staff you value them as human beings?!

Sometimes I don't get a break, and sometimes I have to cut my break short because of work, but I get paid through my lunch, so I can't complain about it. Either pay her during her lunch if you want her to answer the phone during lunch, or back off. She's not a slave. Maybe he didn't get the memo that we can't force people to work without pay.

Federal law REQUIRES that you get a minimum of thirty consecutive minutes for lunch if you are scheduled to work at least four hours at a time, and you're not supposed to be working during this time. I would have sent documentation of these violations to the US Dept of Labor. That fine won't be peanuts for sure.

Seems like a counter intuitive situation whether the daughter of the business owner can't really have an assistant because the father who owns the business is oppressive and drives people to quit leaving only his family as the only willing employees. Until the daughter quits herself he's not going to change. He's a thick headed bully.

What the owner did is super illegal in any state. Federal law doesn't require lunch breaks, but it does require that if you don't give an upaid lunch break, then you have to pay the employee if they are there and working. That includes answering phones. Basically, you can expect an employee to answer phones during their break and pay them as normal, *or* you can have them off the clock and not be expected to do any work until they clock back in. Not both.

I had a lot of trouble following this story because of the repeated use of "like" and "you know". Also referring to her boss as "the girl, the daughter". It was ridiculous!!!! Like, you know, like ridiculous.......

Next time if this happens at your next job, erase your lunch start time if they insist on talking through youe break and when they are done clock out for your 30 min lunch. She should check her state law and see what the department if labor has to say about that. She needs to file a complaint with OSHA and Dept. of Labor. I had a boss like that he could talk, talk, talk and talk about his old days knowing good and well that I take my hr nonpaid break at a certain/same tome everyday for years. Once I told him that my lunch time had passed and I need a break, he. Said he wasnt done and that I should have snacks at my desk. You know what I did, I was like ok M**o since i cant get you on your break you will never catch me slipping ever again. When he tried calling me minutes before I am to clock out either for lunch or the day. I would stare at the phone ringing and clock out on time. He can watch me on camera leaving to have lunch and an adult nap. Sometimes I stare at the phone or go stand in the bathroom until it's time to leave, I am there just waiting lol.

I'm glad she quit. Rude, unreasonable bosses, like this aren't worth anyone's time. That being said, as a medic this line: "Expecting people to work for 8 hours at a time without a gap for a meal is inhumane, and I don’t know many people who would agree to those conditions." Made me laugh, and laugh and then cry a bit.

To me, it wasn't just the fact the man was expecting her to work during her unpaid lunch, it was the overt hostility towards her. The daughter should have given the girl a heads up re her father's behavior when she isn't there to referee.

I had a boss tell edd office I didn't work much, thought I had a drinking problem, ect.. I was having female issues and it was all documented by the hospital. He started requiring us to eat in, and answer phones. Boss proceeds to tell he gave me a job. So I reported him to labor board per instructions of the edd agent. I worked there for7-8mos. He end up owing me $240.00 for my lunches in. Best part he 1 employee there for 3yrs and the other 5yrs. Labor board found he violated the law and had to pay plus pay at overtime rate due to it being a 40hr work week. Tell me I didn't work I was lucky he did me a favor. Well I did his employees a better favor. They got money they were owed for doing him a favor!

You go girl, I had a doctor tell me after taking a 15 minute lunch break never leave again while he's seeing patients, yelled at me in front of everyone and I am a diabetic. Bring back the Unions!! This is why employees want unions their mgmt treats them unfairly.

By Columbus I assumed OH. Federal Law applies to those over 18, and if you are called upon to work during your lunch break you are entitled to get paid for your time. Small businesses can be a lot more demanding than large corporations whether it's fair or not. If it were me I would have left the office for my 30 minute lunch break. I worked for several small companies over the years and rarely got a lunch break if I stuck around, and don't remember ever getting paid whether it was legal or not.

I worked at a country club at 16. 7 hour shifts with not even one five minute break. They gave me chicken tenders and said I could take eat when there was no dishes to wash but brought me more dishes the second I got done with the current ones. 130 Fahrenheit kitchen, no breaks, no food, and little water sips every hour or so, no bathroom breaks longer than 30 seconds, no sitting down while doing work, minimum wage, and I got fired when the manager found me passed out from heat stroke. It was so bad that I couldnt eat outside of work because delicious food of any kind even ice cream tasted like dirty dishwater. They told me to mop with a dry mop cause the right way ( I know now cause my current job is good) was wrong. They burned the food, threw away half of the good food cause the employees "don't deserve to take it home" half of the senior employees didn't do anything ever at all. So for the next 5 years I refused to get a job because I thought jobs were like that.

I don't know what state she lives in, but there should be some state board of labor that she can report this to. I know that she left the job, but if everyone that works for this company filed a complaint, it would be investigated. Especially if MEN complained. I seriously doubt that they would try it with a male employee. That's another reason why they hire women. Lower pay & higher work load placed on women. Also, for the future, leave the building for your lunch break. Especially if you have to clock out. Even if you have to sit in your car. You deserve to eat & also a break from the work environment.

I'm a retired payroll management professional and wage & hour compliance SME. The Fair Labor Standards Act (FLSA) does not include any provision for lunch or rest breaks. It does, however, require employees to be paid for all hours worked. If the employee was expected to take phone calls during her lunch break, these are worked hours under FLSA. The employer cannot demand the employee perform non-compensated labor during his/her lunch break.Furthermore, if the working lunch period extends total work hours to more than 40 per week, federal law requires the hours in excess of forty to be paid at the overtime rate.

I was responsible for a hobby store to close in SE Michigan because they told every hire on that they didn't pay OT. Said that since they informed them prior to them agreeing to work, the law wouldn't do anything about it. I called a friend of my Dad's who worked the Labor Board and gave him all the info. They were closed down, the oldest son went to prison (his daddy was too *sick* to do the time), and EVERY employee they ever had was paid in full for their unpaid overtime. The whole family were a bunch of crooks.

Had a boss told me to quit coming back from lunch knowing I left later than my scheduled time because I couldn't leave till the other lady came back. She always came back late. And no matter how many times I told him this he still got onto me for coming back after my 30 mins which I was late leaving for. So I was shorted time while she got more time. I'm not talking long time late but enough t ok throw off the whole schedule. I worked under him for 3 yrs before moving to another area. Refused to work under him again because that was just one example of his unfair treatment of me.

I remember I used to be forced to work through lunch at a warehouse I used to work at. They didn't explicitly ask me to work through lunch, but they accused me of falling behind if I did take lunch.

Sounds like an illegal situation - at least in Canada. And here’s a tip - never spend your lunch time in the same building. Sometimes you need an actual break from the environment. Take an actual breath of fresh air. I used to work for a call center and it can be such a horrible job that I would need to get out and about.

It's a good thing (for employees)that there's a shortage of workers. It's a sellers market, and our labor is the product. I mean, it's still hard to get a good starting wage, and easier to get a job when you have a job. I wouldn't have approached it that way, but I'm significantly older and quit many a job in my youth because I didn't know better.

This was so difficult to read. The guy has an attitude, I understand. But sit at your desk and ignore a phone call, just let the phone ring because you’re on lunch? Leave the office for 30 mins. Don’t just sit there and let the phone ring in front of you. Bad work ethic.

This may have been a toxic environment, but this person may have not been a stellar employee to begin with either....I always tried to work harder than everyone on my crew, and now I make significantly more than my coworkers with the same job. If you do the absolute bare minimum all the time, you will not be getting any raises or promotions or bonuses, and you will always be passing from job to job with no real stability.

The answer here was to tell the man to respect your lunch break in the first place, not to let the intrusion escalate until you felt the need to leave. You don't gain respect for workers by running away. You get it by holding your ground until you get the respect you're demanding.

So many of these young people are just plain entitled. Everyone is so overly sensitive, if they perceive to be abusive, they quit their job. Should try working a real job. I spent almost 25 yrs as an RN in the OR. Try putting up with scared, sometimes belligerent patients & egotistical surgeons, as well as nursing & hospital mgmt that never has your back. I was on 7 -3 shift & there were many times I didn't even get lunch relief until 2:30. By that time I told them to forget it. WTH I was leaving in 30 min. You can't just walk out of the OR or your state nursing board can revoke your license for patient abandonment.

At first, I wondered if this was a Gen Z problem but her boss was well rude. My experience is if you’re at you desk eating lunch, you’re interruptible - people will say sorry but they wouldn’t see you as off limits. And if you’re at your desk, you would be expected to answer the phone - imagine letting the phone ring while you’re right there 👀. Different story if you’re in the kitchen or a lunchroom. I never understand people anyway who stay in the office at lunchtime. I’m keen to escape for as long as possible and jobs are sedentary enough.

It was extremely hard to read through the so called story. I don't know how many times you can use the word like.. you sound like a whiny person. It's called a working lunch break I have them every day 7 days a week. 2nd if you really want that 30 min break then leave site to eat. It's not complicated. To all the ones say I see lawsuit yeah not going to happen because she quit. Proper business, phone operator #1 is on their legal obligated break? Get phone operator #2 or do it yourself. This is one side of the story and the entitlement from the comments really makes Gen z look even more useless. That being said she didn't handle the situation very well or is flat out lying. Generally if she is allowed to clock out for lunch whoever she's working for would know to to cover the calls. More often then not it's agreed that lunch is paid but you eat around work. This is the norm in many industries. If you want to clock out you can but you don't get paid. Instead of quitng a job she allegedly liked for 6 months she could have had it clarified with her boss and let the daughter deal with her father. That would have been the grown thing to do

FYI, to anyone in California - what happened here is illegal. If you're interrupted to work during your lunch, you legally get to restart your lunch all over again. This restart does not have extra time taken out of your paycheck (e. If you're 15 minutes into your 30 minute lunch and are interrupted to work, you can restart your 30 minutes - your employer cannot take that extra time out of your paycheck). You can also restart as many times as you are interrupted. If are not able to restart your lunch, for whatever reason, or cannoy take a lunch at all, your employer must pay you 1 hour of overtime (even if your lunch was only going to be 30 minutes). Know your rights! Source: live in CA, and am a manager who trained on HR law by my company (who were smart to do this because they want to make sure I wouldn't be a bad manager who'd get them sued for unknowingly breaking labor laws).

It's illegal under federal law too, though for different reasons. If they are off the clock, they are not to be doing any work. You don't have to give an unpaid lunch break (under federal law), but if you do, then like in California, it has to be a true break from work (including answering phones).

This is why workers are so frustrated!! One day I was running around, trying to do a bunch of things at once - wasn't even thinking, and I interrupted one of my staff member's lunch breaks. She patiently answered my questions, and then i realized/remembered she was on break! I felt so bad that I told her to clock back in and continue on her lunch break. How hard is it to show your staff you value them as human beings?!

Sometimes I don't get a break, and sometimes I have to cut my break short because of work, but I get paid through my lunch, so I can't complain about it. Either pay her during her lunch if you want her to answer the phone during lunch, or back off. She's not a slave. Maybe he didn't get the memo that we can't force people to work without pay.

Federal law REQUIRES that you get a minimum of thirty consecutive minutes for lunch if you are scheduled to work at least four hours at a time, and you're not supposed to be working during this time. I would have sent documentation of these violations to the US Dept of Labor. That fine won't be peanuts for sure.

Seems like a counter intuitive situation whether the daughter of the business owner can't really have an assistant because the father who owns the business is oppressive and drives people to quit leaving only his family as the only willing employees. What the owner did is super illegal in any state. Federal law doesn't require lunch breaks, but it does require that if you don't give an upaid lunch break, then you have to pay the employee if they are there and working. That includes answering phones. Basically, you can expect an employee to answer phones during their break and pay them as normal, *or* you can have them off the clock and not be expected to do any work until they clock back in. Not both.

Next time if this happens at your next job, erase your lunch start time if they insist on talking through youe break and when they are done clock out for your 30 min lunch. She should check her state law and see what the department if labor has to say about that. She needs to file a complaint with OSHA and Dept. of Labor. I had a boss like that he could talk, talk, talk and talk about his old days knowing good and well that I take my hr nonpaid break at a certain/same tome everyday for years. Once I told him that my lunch time had passed and I need a break, he. Said he wasnt done and that I should have snacks at my desk. You know what I did, I was like ok M**o since i cant get you on your break you will never catch me slipping ever again. When he tried calling me minutes before I am to clock out either for lunch or the day. I would stare at the phone ringing and clock out on time. He can watch me on camera leaving to have lunch and an adult nap. Sometimes I stare at the phone or go stand in the bathroom until it's time to leave, I am there just waiting lol.

I had a boss tell edd office I didn't work much, thought I had a drinking problem, ect.. I was having female issues and it was all documented by the hospital. He started requiring us to eat in, and answer phones. Boss proceeds to tell he gave me a job. So I reported him to labor board per instructions of the edd agent. I worked there for7-8mos. He end up owing me $240.00 for my lunches in. Best part he 1 employee there for 3yrs and the other 5yrs. Labor board found he violated the law and had to pay plus pay at overtime rate due to it being a 40hr work week. Tell me I didn't work I was lucky he did me a favor. Well I did his employees a better favor. They got money they were owed for doing him a favor!

By Columbus I assumed OH. Federal Law applies to those over 18, and if you are called upon to work during your lunch break you are entitled to get paid for your time. Small businesses can be a lot more demanding than large corporations whether it's fair or not. If it were me I would have left the office for my 30 minute lunch break. I worked for several small companies over the years and rarely got a lunch break if I stuck around, and don't remember ever getting paid whether it was legal or not.

I worked at a country club at 16. 7 hour shifts with not even one five minute break. They gave me chicken tenders and said I could take eat when there was no dishes to wash but brought me more dishes the second I got done with the current ones. 130 Fahrenheit kitchen, no breaks, no food, and little water sips every hour or so, no bathroom breaks longer than 30 seconds, no sitting down while doing work, minimum wage, and I got fired when the manager found me passed out from heat stroke. It was so bad that I couldnt eat outside of work because delicious food of any kind even ice cream tasted like dirty dishwater. They told me to mop with a dry mop cause the right way ( I know now cause my current job is good) was wrong. They burned the food, threw away half of the good food cause the employees "don't deserve to take it home" half of the senior employees didn't do anything ever at all. So for the next 5 years I refused to get a job because I thought jobs were like that.

I don't know what state she lives in, but there should be some state board of labor that she can report this to. I know that she left the job, but if everyone that works for this company filed a complaint, it would be investigated. Especially if MEN complained. I seriously doubt that they would try it with a male employee. That's another reason why they hire women. Lower pay & higher work load placed on women. Also, for the future, leave the building for your lunch break. Especially if you have to clock out. Even if you have to sit in your car. You deserve to eat & also a break from the work environment.

I'm a retired payroll management professional and wage & hour compliance SME. The Fair Labor Standards Act (FLSA) does not include any provision for lunch or rest breaks. It does, however, require employees to be paid for all hours worked. If the employee was expected to take phone calls during her lunch break, these are worked hours under FLSA. The employer cannot demand the employee perform non-compensated labor during his/her lunch break.Furthermore, if the working lunch period extends total work hours to more than 40 per week, federal law requires the hours in excess of forty to be paid at the overtime rate.

I was responsible for a hobby store to close in SE Michigan because they told every hire on that they didn't pay OT. Said that since they informed them prior to them agreeing to work, the law wouldn't do anything about it. I called a friend of my Dad's who worked the Labor Board and gave him all the info. They were closed down, the oldest son went to prison (his daddy was too *sick* to do the time), and EVERY employee they ever had was paid in full for their unpaid overtime. The whole family were a bunch of crooks.

Had a boss told me to quit coming back from lunch knowing I left later than my scheduled time because I couldn't leave till the other lady came back. She always came back late. And no matter how many times I told him this he still got onto me for coming back after my 30 mins which I was late leaving for. So I was shorted time while she got more time. I'm not talking long time late but enough t ok throw off the whole schedule. I worked under him for 3 yrs before moving to another area. Refused to work under him again because that was just one example of his unfair treatment of me.

Sounds like an illegal situation - at least in Canada. And here’s a tip - never spend your lunch time in the same building. Sometimes you need an actual break from the environment. Take an actual breath of fresh air. I used to work for a call center and it can be such a horrible job that I would need to get out and about.

It's a good thing (for employees)that there's a shortage of workers. It's a sellers market, and our labor is the product. I mean, it's still hard to get a good starting wage, and easier to get a job when you have a job. I wouldn't have approached it that way, but I'm significantly older and quit many a job in my youth because I didn't know better.

This may have been a toxic environment, but this person may have not been a stellar employee to begin with either....I always tried to work harder than everyone on my crew, and now I make significantly more than my coworkers with the same job. If you do the absolute bare minimum all the time, you will not be getting any raises or promotions or bonuses, and you will always be passing from job to job with no real stability.

So many of these young people are just plain entitled. Everyone is so overly sensitive, if they perceive to be abusive, they quit their job. Should try working a real job. I spent almost 25 yrs as an RN in the OR. Try putting up with scared, sometimes belligerent patients & egotistical surgeons, as well as nursing & hospital mgmt that never has your back. I was on 7 -3 shift & there were many times I didn't even get lunch relief until 2:30. By that time I told them to forget it. WTH I was leaving in 30 min. You can't just walk out of the OR or your state nursing board can revoke your license for patient abandonment.

At first, I wondered if this was a Gen Z problem but her boss was well rude. My experience is if you’re at you desk eating lunch, you’re interruptible - people will say sorry but they wouldn’t see you as off limits. And if you’re at your desk, you would be expected to answer the phone - imagine letting the phone ring while you’re right there 👀. Different story if you’re in the kitchen or a lunchroom. I never understand people anyway who stay in the office at lunchtime. I’m keen to escape for as long as possible and jobs are sedentary enough.

Hope she never finds work again. It's being insubordinate and not a team player. Of course you answer the phone! Lunch or not. Just add the extra time onto your break. You do not keep customers waiting.

How to tell a boomer is a boomer right here. Sacrifice your time and life for the business. Business comes first, employees came last mentality. Proper business, phone operator #1 is on their legal obligated break? Get phone operator #2 or do it yourself. You don't try to violate LABOR LAWS because your company is so poorly set up, you can't handle someone have lunch without losing money.

This is one side of the story and the entitlement from the comments really makes Gen z look even more useless. That being said she didn't handle the situation very well or is flat out lying. Generally if she is allowed to clock out for lunch whoever she's working for would know to to cover the calls. More often then not it's agreed that lunch is paid but you eat around work. This is the norm in many industries. If you want to clock out you can but you don't get paid. Instead of quitng a job she allegedly liked for 6 months she could have had it clarified with her boss and let the daughter deal with her father. That would have been the grown thing to do

So she clocked out for a 30 minute lunch break just like millions of people do every single day and you think she's lying? You have no clue what you're talking about if you think most jobs expect people to work through an unpaid 30 minute break. YTA by the way.
