Teen Reports Her Boss For Sexual Harassment, Gets Panic Attack After Seeing Boss’s Response
In the wake of Harvey Weinstein’s recent sex scandal, the debate on sexual assault and harassment has reached an all-time boiling point. With so much adversity being directed toward victims, it’s not hard to see why some choose to keep their ordeal inside. One 18-year-old former Chili’s employee decided to raise her voice about a manager that sexually harassed her over a period of 2 years, and the reaction she was met with proves exactly why so many suffer in silence.
Emily Houser was just 16 when she started working at a Chili’s restaurant in Whitehall, Pennsylvania. She claims that her manager, Josh Davidson, took an immediate interest in her, and began showing up at her home and school with unwanted gifts on a frequent basis. When all of his advances were rejected, he began treating Emily with contempt at work, and apparently moved on to another young girl. That was the final straw for Emily, who then reported Davidson’s actions to the Chili’s corporate headquarters – and got him transfered to a different location.
Her former coworkers weren’t too happy with how it all went down, and decided to post a particularly cruel joke on Instagram after Emily herself resigned from the restaurant. Though it left her with a bruised soul, a Chili’s spokesperson has since told Buzzfeed News that Davidson has now been fired altogether. A bittersweet ending to a saddening story. Read more below, and tell us what you think in the comments.

After the manager was transferred away as a result, she turned on Instagram to find this
They had sided with the popular Josh Davidson, who Emily says stalked and propositioned her over a 2-year period

Though she had then left Chili’s, she reported the ‘party’ to corporate headquarters, leading to Davidson’s firing

People are saying that this is exactly why so many victims of assault and harassment choose to stay silent
Others, however, sense more to the story

Share on FacebookThe boss in my opinion is at fault: 1. He's the one who was spreading the sensitive information, he was also an adult when the alleged harassment began (she was only 16), and his conduct during the 2 years, in exploiting the situation, and allowing a celebration geared towards hate, is not only unprofessional, but also disturbing. This to me sounds like one of those cases where "oh she dresses or acts a certain way, so she was asking for it." When in reality, "no" means NO! No clue what the manager's age was, but he sounds like he's emotionally insecure, and gets off on asserting his power. Dangerous recipe. Glad he was fired.
No matter whose side you're on, those "coworkers" are disgusting -_-
My point exactly! Not sure what is unclear about that, nor am I surprised guys are the ones stuck in the grey area, looking for some kind of justification.
Load More Replies...For the people who are saying that we don't have the whole story, the cake says it all. Who would throw a party for that purpose?
Sexual harassment, at least in my experience, is a lot about control. So, I wouldn't be shocked if this party (and the fact that it got out to her) was also about control.
Load More Replies...It is actually very ordinary for people to side with scum rather than believe what a woman says about being abused. The staffers that had the "party" were typical. The liked their boss because he was such a pond scum that they felt free to do whatever they wanted, and when he was fired, they blamed the victim. ... What's sickening to me is the women who are accusing her of lying. Why would she lie? Why would she choose to put herself in a position where she would be abused all over again? .... Her situation happens every day - and her employer victimized many kids over the years. I've been fired for refusing to screw my boss, too. This is the way it is. People who accuse women of lying need a firm smack in the chops with a dead salmon.
I had pass by something similar, that wasn't a boss, but my college teacher. I was harassed like other girls at school. My final exams was almost A and B levels except from this teacher. I didn't report him, I was too scared. But I asked help with another teacher and that was my salvation. The other girl from another group fail with him. It is a shame woman instead to stand up for support we are the first one to discriminate or make nasty comments. I know how uncomfortable being harassed and not wish to no one else.
Load More Replies...#MeToo - Good for her for speaking up. AND even if she was part of the original problem, it is absolutely unethical for any manager to be so petty as to respond with such a cake and a party. Corporate Chili's response is appropriate even if it was just for the cake and the party.
And yet people wonder why we can't come out about these things. For f**k's sake, he was so much older than her, and she was a MINOR and yet people are so pathetic and disgusting that they would see her as in the wrong. Just like Lady Gaga's song, I guess few could fully understand till it happens to you. I am so disappointed in all of you who believe that this creepy behavior is justified for ANY reason. "More to the story" my f*****g a*s. Any other details may exist and may change things a little, but creepy, stalker behavior- especially to a minor- is never, never okay.
agreed sexual harassment, stalking and the like is never ok. But there's other things that aren't ok, like rushing to judgement and assuming a 18 year olds social media post is 100% accurate. You sound like a religious fanatic, assuming because someone said they know gods plan, it must be true. You see how some people might doubt a person's claim until they know the full story? No one is justifying anything, not one comment I've seen. Most people just have doubts until they know enough to draw a conclusion. A fired manager, from a company that doesn't want to be portrayed in a bad light, and a 18 year old employee that was for some reason hated by what looks like all male and female employees, raises serious doubts about what happened. Don't equate "I don't know enough to judge" with "I support sexual harassment." If you disagree, the next time Jehovah's Witnesses come to your door, don't doubt anything they say, believe them without question like you do teenage Facebook posts.
Load More Replies..."Especially an attractive woman"... What the actual f**k?! It's more acceptable to harass a less fortunate looking woman now?
Assuming you're talking about Mark Klein's Facebook comment, that's not what he said? He said that attractive women generally experience more sexual harassment than unattractive women. I guess you could interpret that as meaning, "It's better to harass unattractive women because they experience less harassment to start with," but that's a real stretch.
Load More Replies...I was sexually hassressed for over 12 years and being a single mom I was afraid I would be fired if I reported it. No one knows the mirsery you go through every day and the sickness you feel. I finally married and that didn't stop him. I could hardly stand my husband touching me. It really messed with my sex life at home. I finally quit after 15 years and felt free, but I know in my heart if I had reported him I would have been fired . Please someone find the answers for us women.
I'm proud of her people need to report this c**p-it is not acceptable is someone says sorry not interested leave them alone. I'm sickened by the coworkers-who are you people that did that? like really pathetic
I'm proud of her-a person should report the bad behavior-not all men do it but those who do grow up-I'm sickened with the coworkers-shame on them they are pathetic scum themselves.
Disgusting boss, disgusting employees. She doesn't have to be perfect; we all need to be able to exercise our right to speak out against sexual harassment without reprisal.
Yes conversations should without a doubt always be one sided.
Load More Replies...Did she handle it right? Why is that even a f*****g question? She did the right thing. It's everyone else in this story who needs looking at.
The problem here is that we do not have all the facts. We do not have the boss's side. We do not know what the internal investigation by Chili's showed. I'm not saying Emily is wrong, we just do not know all the info. I dealt with 2 sexual harassment cases at a former job. In one, everything was documented, and recorded video backed this up, as did coworkers. In the other, there was no evidence, and no witnesses. Video did not back up certain claims. The employee in question was, in fact, a total jerk, but, there was no evidence to terminate.
Yeah but then again... throwing a party with a cake that says "f**k Emily Houser" and hoping that she sees it is pretty vicious, no matter the circumstances.
Load More Replies...Let's remember that predators like this can be charming and often single out their victims when others are not around to witness. The co-workers were just following the boss' lead and likely concerned about saving their own jobs. It is sad that none of them were brave enough to come to her defense. Sounds like she has some self-respect and I hope the truth will come out and be liberating for her.
Often the predators buddy up to their subordinates, not requiring much from them, for a layer of protection. It certainly worked here.
Load More Replies...She reported it when he began to prey on another because she could stand it herself, but saw it to be a pattern, and chose to protect others. Anyone assigning a nefarious motive to her actions obviously can't see outside their own selfish world view. I've been where this young woman was, and the manager was seen by my co-workers as a buddy, not a boss. He bent rules to make friends, and the fact I didn't play along put me outside their group. Harassment from them was rewarded by the boss, so it continued and I quit. Victims often wait until they leave to report this behavior because they need the paycheck. With a bad reference, finding work is hard if one's resume has just one job on it. Sadly predators thrive in these environments, where young victims are numerous and oversight is minimal.
This happened in a country where nearly half of the voter voted for sexual predator, so I'm not surprise. :(
Ah you must be talking about Bill Clinton and I couldn't agree more.
Load More Replies...Glad he was inconvenienced by being transferred. He's poison, throws a f*****g petty party, won't change anything! Bye bye pervert! And the female employees are pathetic for siding with him.
They eventually fired him and the entire crew that threw the "party".
Load More Replies...she took the correct action and is VERY strong to have sone so. I wish I had been that strong. Chili's should be taken to court for not firing the manager.
It's so f*****g typical that several people either don't believe her or think she actually got mad and it started after he "moved on to another girl". How unbelievably maddening this attitude is. YES it f*****g happens JUST LIKE THIS and yes this woman should be believed. You people who don't believe her are so much a part of the problem that it' s laughable that you don't see it. Un-f*****g-believable!!! My God. Wake up.
It's typical because there are still people out there who believe evidence over a stranger's word. Every allegation should be taken seriously and exhaustively investigated but to take a person's word alone on such serious allegations would not be sane, fair, logical, practical or productive, especially when there are serious consequences involved like loss of employment. That's not how justice works, an important prase to keep in mind is 'innocent until proven guilty'. I hope the system can be changed to better achieve justice for the countless victims of assault and harassment out there but potentially creating another victim out of the accused. Now I'm not saying this is this case and I'm not accusing the girl of lying, I'm simply open to the possibility, because a)there's not much conclusiv information presented and b) the alternative of immediately condemning one person solely on the word of another is not justice but blind fanaticism.
Load More Replies...His has proved her report was true. No further demonstration needed of that abuser.
If you weren't witness to the harassment then your negative opinion means s**t. It takes a brave person to come forward. I'm disgusted with that staff. It took me 20 years to come forward with my abuses and THIS is exactly why. It's this type of mob mentality that keeps the abusers abusing. Those co workers suck. #metoo I'm with Emily.
Fire all the co workers it’s collusion. A manager has a duty of care to employees he or she is managing. Clearly the leadership and management in this place of employment was not safe for employees. End of. No emotions but fire.
clearly there is evidence of this further aggravation or the company would not have straight fired him. we shouldn't have to live in a world where men can do as they want and it can just be waved off. We need to hold everyone accountable for their actions.
neb are not the only ones that do this when they are in the position to be a boss.
Load More Replies...Reporting a crime does not make you a brave person, it makes you a responsible person. You will probably prevent other crimes from occurring.
I'm glad she was able to stand up for herself even after the other employees reactions
I am so confused by this story. Why would all of her co workers hate her? There is more going on than has been said is my gut feeling on this. The manager sounds like a really disgusting and cruel individual regardless
Maybe she's an unpleasant, unlikable person. That doesn't make it okay to harass her.
Load More Replies...So to all of you self indignant people defending this 26 year old man, would your opinion change if it was your daughter he was harassing? We don't know the whole story but we know enough to know that the manager was first moved and then fired for his behavior. The other coworkers clearly were bullying her, having such a party with a cake takes it to a whole different level. They shouldn't even have been told why he was transfered! But we all know in these types of environments that rumors spread and the herd mentality sets in and she ends up being the bad guy. The statement of her speaking up when he moved on to another girl means that she realized that he wasn't going to stop ever untless someone called him out for his aweful behavior! I had a job once in which the hiring manager would perform the pencil test prior to hiring waitresses and he would watch girls pick up a pencil and if he liked what he saw he would hire them. People in power do messed up things!
There is no way to make a decision here. I don't know enough about what actually happened. I would need more facts before I could form an opinion.
wow, no one cares about you needing more information. The decisions by the parties involved have already been made
Load More Replies...OK A MINOR IS A MINOR AND A SEXUAL PREDATOR IS A SEXUAL PREDATOR..AMEN!
The people wondering how the crew turned again'st her after her former boss informed them of her reporting and no doubt lying his a*s off. I'm guessing they think they are way more popular with their co-workers than they actually are.
he throw a party and have that words written in the cake! it's a second round of sexual harassment..in verbal form...no women would feel safe seeing that picture, I pray that Emily will be a strong woman to overcome this situationn
God only knows what sort of "spin" the manager put on it. He may have made it sound like she made it all up to get even because HE was refusing HER advances - which is an extremely common situation. I've worked with guys like this before. Luckily I was the manager, who knew for a fact the make employee was hitting on a young lady who wasn't interested (she had complained twice and he had already been reprimanded). He tried exactly that - it was her not me! Several employees backed her claims and the third time he made an advance he was immediately fired (not a terribly bright guy). He then threatened to sue the company. I told him I had written eyewitness testimony and his reprimand on file, so bring it on! Never heard from him again.
Those people who didn't believe this story are just as bad as those workers and also just as stupid. I guess you have to know bullies like I do. He posted very sensitive and private information to his coworkers. He probably dressed it up a bit to make them all think she must be ridiculous. Bullies like to be the first to rally as many people on their side as possible. That's their nature. On his own he is weak. Surrounded by a bunch of nasty followers it's like he has gotten the majority vote in his mind and his actions are validated.
A f*ck her party? Isn't that wants he wanted to do? Are they mad because they did and she wouldn't? Time to grow up.
Could you pls do the story where Madonna harassed a teenage girl on stage? She was 17(!) and Madonna pulled her top down and thousands of people could see her naked breast.
Please do. But that would be a different story. Let us focus on the one above, or is that what you'd wish we ignore? Women can be predators too, of course.
Load More Replies...They need to fire the people who worked there also who responded. Then arrest the former manager and prosecute him.
Bullying is a big problem in America starting at the very top of the food chain or the bottom, depending on your political affiliation
I'm glad she received justice. I went through a harassment situation myself at Compass Airlines. I ended up quitting like others before me.They don't have a department to report it to. The only one I could even try to complain about it, was the one doing the harassment. He blocked me on just about everything. So sorry this girl had to endure the hate that followed after it was settled by the company and continue to be a victim.
I'm glad I'm old and ugly. Even when I was young, I was ugly, so I never had to deal with this c**p. Growing older has just made me even safer.
Looks don't always have anything to do with it, it's really a power play and this jerk saw these people, even the ones he got to go along with his hateful actions as someone beneath him and who he could control. The guy is a vile worm.
Load More Replies...I just want to know what that cake said. I mean it’s censored so there’s no way anybody can figure it out.
He may have seemed to be a great manager to the other workers. Perhaps he overlooked imperfections in their tasks to be more of a buddy and have them on his side. Regardless, he should have been reported to the authorities. If he did it once, he will most likely do it again. And, those co-workers should have been release from their duties as well.
Maybe she didn't handle it well, but why should she be condemned for it? Being abused will move people to react in bizarre ways, and if it was the first time it happened to her we can understand lack of experience, right? And hope she doesn't get too much experience at having to deal with this c**p.
Why isn't there a pic of this Josh creep? Looked everywhere, can't find one. I just want to see what this idiot looks like.
She could always be lying, a blatant clue is this follows the same pattern of waiting months or years to report it
In the wake of so many people claiming sexual harasment all because they dont like there bosses it gets harder and harder to tell the real from the fake notsaying they did the right thing but how do we know she didnt just have a grudge against him cause he wouldent give her a day off that she requested you people forget how petty teens are and he did not handle that the right way but how can you honestly sit there and say you wouldent retaliate of someone accused you of sexualy assulting them and everyone believed them even though they have nothing to show for it.? Dont b******t.
Apparently moved on to another young girl. That was the final straw for Emily....... Story writes itself!
I like how people just assume her side of the story is the correct one, maybe it is, but if it truly is does it really make sense that people would side with the manager and not her? What if she was the one hitting on him and got tired of him ignoring her and made it all up? You weren't there, you can't fairly judge the situation, so sit down and shut up, lol.
sadly this is what happens when it is not reported as soon as it happens! if she was only 16 and an adult male was hitting on her showing up at her house with unwanted gifts the police should of been called right then and there. where were her parents? why didn't they step in? and while I do realize that most of the time the victim gets bullied or shamed we MUST teach our kids and even ourselves to speak up as soon as it happens don't wait 2, 3 years down the line SPEAK UP NOW!
Jesus Christ, Marlene. Have you ever been sexually harassed? It's not as easy as speaking up the moment it happens. I was harassed at 21 by a man twice my age and I still haven't even mentioned it to my family or friends because I felt like it was somehow my fault and no one would believe me. She was 16 when this happens. Just a kid yet!!! She was probably petrified.
Load More Replies...I`m not saying this is not true because the guy got fired for a reason. But it`s either more than one person to blame here (`he apparently moved on to another young girl. That was the final straw for Emily, who then reported Davidson’s actions to the Chili’s corporate headquarters`), or it`s just boredpanda`s (another) terrible wording.
She didn't want to see someone else victimized. What kind of perverted mind do you have that you think she WANTED to be stalked and harassed?
Load More Replies...I gotta ask. Is there a difference between propositioning a girl and harrassment? I mean saying banana-nana constantly would be annoying as well, but then being reported and publicly known as a girl-harrasser(forgive the made-up word) for it is unwarranted. Girl shud have said I was annoyed by my boss who would not relent approaching me. THe disgusting thing ofcos is that he did this to a minor. But there no indication of whether there was unfair treatment due to her refussal etc. Isn't it quick to jump on the sexual harrassment train with a proposal gone too long?
If she was only 16 when she started working there ,that means she still lived with her parents. And I'm sure if they were any kind of good parents , they asked her how it was going at her job now and then. And being a parent myself, I ask my boys how their day was everyday when they come home from school and I can just about always tell when something is up or wrong. Kids don't hide their feeling very well, so that being said , did she really have these problems at work and why didn't her parents know anything was wrong? they should have known something was wrong after 2 years . And is she just saying this just to get attention ? but , this story doesn't really have this managers side of the story. he could be a low life , or maybe the company fired him because they didn't want all the attention drawn to them. Who knows ? but since she was under age why hasn't it gone to court ?
This is for the author of the article: "he began treating Emily with contempt at work, and apparently moved on to another young girl. That was the final straw for Emily" - I know the intention was to express the idea that the initial victim took a stand when the aggressor tried to take advantage of a new victim, due to the arrangement of words it is possible for some people to understand the victim was upset not being the center of attention anymore though, and that can be detrimental to your article. All the best, A.
Idiot. She couldn't stand seeing someone else abused. How thick are you?
Load More Replies...We are definitely only hearing one side of this story. There must be a very interesting reason as to why she's hated by every single other person there.
You shouldn't just believe someone just because they are saying it. There is a little thing called innocent until proven guilty. Here is what we know: Emily Houser claims sexual harrasment and gets manager transferred. Manager infroms staff what has happened. Staff throws a F**k Emily Houser party Emily Houser informs corporate headquarters of this party. Corporate headquarters don't want to deal with a sexual harrasment debacle (which is bad PR) and thus fires Josh Davidson A large number of former coworkers side with Josh. There is clearly something more to this story and everyone should reserve judgement until proof has been supplied. As for now Emily Houser is the prosecutor and thus has to prove a sexual harrasment has happended. Josh Davidson is the defendant and need only to disprove the prosecutors evidence with counter evidence This should happen in a court of law and they should be called nothing more than prosecutor and defendant until a ruling has been made.
Riiiight. Tell me if you agree to this statement: "He didn't do it, but she was asking for it anyway." ... if your answer is yes - and it is - then you are nothing more than the pond scum who think that abusing and harassing minor children is a good thing. NO ONE is going to trial. There is NO COURT CASE. He was fired for cause.
Load More Replies...ok....but where's the proof though? In this article we only see what happened after the supposed harassment. Why would ALL her coworkers be against her if she was harassed for 2 whole years?! 2 whole years and we don't see a text or even a picture proving anything, all we see is posts from people who've already "closed the case". This seems extremely fishy in my opinion and i find it very uncomfortable seeing most of you play judge and jury without any context at all. For all we know the situation could be the other way around. I don't know what twisted logic makes you feel you have the right to judge people by irrelevant facts but it's the same logic that lead us to the middle f*****g ages (hope you've heard of it)...this is absolutely sickening to see in our age!!! I hope this mindless mentality STAYS in america where it was born, no offense to the thinking Americans out there but i'm sure you see it yourselves anyway..................freaking apes man...jeez

As a person who has been sexually harassed multiple times over quite some time, it feels rather embarrassing telling others about it. My bosses were absolutely vile at this cafe I worked at. Sadly, in my experience, when something like this happens most of the guys stand with the guy that's being accused. Most of the girls follow the guys so they'll stay favorable in their eyes. I agree that there's more to the story. But the fact that he participated in a party dedicated to hating on somebody is enough to be terminated.
Sometimes, there's not always proof that it happened.

As a person who has been sexually harassed multiple times over quite some time, it feels rather embarrassing telling others about it. My bosses were absolutely vile at this cafe I worked at. There was no one to report the harassment either. There was no one higher than them, there. This happened over 4 and a half years.
Load More Replies...Well, perhaps if people were to not talk in such a disgusting, vile way, or touch people inappropriately, then there wouldn't be any of this?!
Load More Replies...Why are you 'lol'-ing? What exactly about harassment do you find funny? Just because that behavior is rampant in one area doesn't make it right or normal.
Load More Replies...Do you know what it's like to be a 16 year old female? The women her age are most likely WORSE than the men. You don't know the ages of the staff. They could all be teenagers. And I think any employee in attendance should also be fired for bullying.
