In the wake of Harvey Weinstein’s recent sex scandal, the debate on sexual assault and harassment has reached an all-time boiling point. With so much adversity being directed toward victims, it’s not hard to see why some choose to keep their ordeal inside. One 18-year-old former Chili’s employee decided to raise her voice about a manager that sexually harassed her over a period of 2 years, and the reaction she was met with proves exactly why so many suffer in silence.

Emily Houser was just 16 when she started working at a Chili’s restaurant in Whitehall, Pennsylvania. She claims that her manager, Josh Davidson, took an immediate interest in her, and began showing up at her home and school with unwanted gifts on a frequent basis. When all of his advances were rejected, he began treating Emily with contempt at work, and apparently moved on to another young girl. That was the final straw for Emily, who then reported Davidson’s actions to the Chili’s corporate headquarters – and got him transfered to a different location.

Her former coworkers weren’t too happy with how it all went down, and decided to post a particularly cruel joke on Instagram after Emily herself resigned from the restaurant. Though it left her with a bruised soul, a Chili’s spokesperson has since told Buzzfeed News that Davidson has now been fired altogether. A bittersweet ending to a saddening story. The boss in my opinion is at fault: 1. He's the one who was spreading the sensitive information, he was also an adult when the alleged harassment began (she was only 16), and his conduct during the 2 years, in exploiting the situation, and allowing a celebration geared towards hate, is not only unprofessional, but also disturbing. This to me sounds like one of those cases where "oh she dresses or acts a certain way, so she was asking for it." When in reality, "no" means NO! No clue what the manager's age was, but he sounds like he's emotionally insecure, and gets off on asserting his power. Dangerous recipe. Glad he was fired.

People like slm do not help these discussions with their heated responses. In what world do you communicate with people on a sensitive subject by attacking them. Whether you agree with them or not. They have done nothing to warrant name calling. Calm down and do something constructive like explaining the fault in their thinking. Or help them understand a point of view. It is actually very ordinary for people to side with scum rather than believe what a woman says about being abused. The staffers that had the "party" were typical. The liked their boss because he was such a pond scum that they felt free to do whatever they wanted, and when he was fired, they blamed the victim. ... What's sickening to me is the women who are accusing her of lying. Why would she lie? Why would she choose to put herself in a position where she would be abused all over again? .... Her situation happens every day - and her employer victimized many kids over the years. I've been fired for refusing to screw my boss, too. This is the way it is. People who accuse women of lying need a firm smack in the chops with a dead salmon.

I had pass by something similar, that wasn't a boss, but my college teacher. I was harassed like other girls at school. My final exams was almost A and B levels except from this teacher. I didn't report him, I was too scared. But I asked help with another teacher and that was my salvation. The other girl from another group fail with him. It is a shame woman instead to stand up for support we are the first one to discriminate or make nasty comments. I know how uncomfortable being harassed and not wish to no one else.

agreed sexual harassment, stalking and the like is never ok. But there's other things that aren't ok, like rushing to judgement and assuming a 18 year olds social media post is 100% accurate. You sound like a religious fanatic, assuming because someone said they know gods plan, it must be true. You see how some people might doubt a person's claim until they know the full story? No one is justifying anything, not one comment I've seen. Most people just have doubts until they know enough to draw a conclusion. A fired manager, from a company that doesn't want to be portrayed in a bad light, and a 18 year old employee that was for some reason hated by what looks like all male and female employees, raises serious doubts about what happened. Don't equate "I don't know enough to judge" with "I support sexual harassment." If you disagree, the next time Jehovah's Witnesses come to your door, don't doubt anything they say, believe them without question like you do teenage Facebook posts.

Assuming you're talking about Mark Klein's Facebook comment, that's not what he said? He said that attractive women generally experience more sexual harassment than unattractive women. I guess you could interpret that as meaning, "It's better to harass unattractive women because they experience less harassment to start with," but that's a real stretch.

I was sexually hassressed for over 12 years and being a single mom I was afraid I would be fired if I reported it. No one knows the mirsery you go through every day and the sickness you feel. I finally married and that didn't stop him. I could hardly stand my husband touching me. It really messed with my sex life at home. I finally quit after 15 years and felt free, but I know in my heart if I had reported him I would have been fired . Please someone find the answers for us women.

The problem here is that we do not have all the facts. We do not have the boss's side. We do not know what the internal investigation by Chili's showed. I'm not saying Emily is wrong, we just do not know all the info. I dealt with 2 sexual harassment cases at a former job. In one, everything was documented, and recorded video backed this up, as did coworkers. In the other, there was no evidence, and no witnesses. Video did not back up certain claims. The employee in question was, in fact, a total jerk, but, there was no evidence to terminate.

Let's remember that predators like this can be charming and often single out their victims when others are not around to witness. The co-workers were just following the boss' lead and likely concerned about saving their own jobs. It is sad that none of them were brave enough to come to her defense. Sounds like she has some self-respect and I hope the truth will come out and be liberating for her.

She reported it when he began to prey on another because she could stand it herself, but saw it to be a pattern, and chose to protect others. Anyone assigning a nefarious motive to her actions obviously can't see outside their own selfish world view. I've been where this young woman was, and the manager was seen by my co-workers as a buddy, not a boss. He bent rules to make friends, and the fact I didn't play along put me outside their group. Harassment from them was rewarded by the boss, so it continued and I quit. Victims often wait until they leave to report this behavior because they need the paycheck. With a bad reference, finding work is hard if one's resume has just one job on it. Sadly predators thrive in these environments, where young victims are numerous and oversight is minimal.

It's typical because there are still people out there who believe evidence over a stranger's word. Every allegation should be taken seriously and exhaustively investigated but to take a person's word alone on such serious allegations would not be sane, fair, logical, practical or productive, especially when there are serious consequences involved like loss of employment. That's not how justice works, an important prase to keep in mind is 'innocent until proven guilty'. I hope the system can be changed to better achieve justice for the countless victims of assault and harassment out there but potentially creating another victim out of the accused. Now I'm not saying this is this case and I'm not accusing the girl of lying, I'm simply open to the possibility, because a)there's not much conclusiv information presented and b) the alternative of immediately condemning one person solely on the word of another is not justice but blind fanaticism.

So to all of you self indignant people defending this 26 year old man, would your opinion change if it was your daughter he was harassing? We don't know the whole story but we know enough to know that the manager was first moved and then fired for his behavior. The other coworkers clearly were bullying her, having such a party with a cake takes it to a whole different level. They shouldn't even have been told why he was transfered! But we all know in these types of environments that rumors spread and the herd mentality sets in and she ends up being the bad guy. The statement of her speaking up when he moved on to another girl means that she realized that he wasn't going to stop ever untless someone called him out for his aweful behavior! I had a job once in which the hiring manager would perform the pencil test prior to hiring waitresses and he would watch girls pick up a pencil and if he liked what he saw he would hire them. God only knows what sort of "spin" the manager put on it. He may have made it sound like she made it all up to get even because HE was refusing HER advances - which is an extremely common situation. I've worked with guys like this before. Luckily I was the manager, who knew for a fact the make employee was hitting on a young lady who wasn't interested (she had complained twice and he had already been reprimanded). He tried exactly that - it was her not me! Several employees backed her claims and the third time he made an advance he was immediately fired (not a terribly bright guy). He then threatened to sue the company. I told him I had written eyewitness testimony and his reprimand on file, so bring it on! Never heard from him again.

I'm glad she received justice. I went through a harassment situation myself at Compass Airlines. I ended up quitting like others before me.They don't have a department to report it to. The only one I could even try to complain about it, was the one doing the harassment. He blocked me on just about everything. So sorry this girl had to endure the hate that followed after it was settled by the company and continue to be a victim.

He may have seemed to be a great manager to the other workers. Perhaps he overlooked imperfections in their tasks to be more of a buddy and have them on his side. Regardless, he should have been reported to the authorities. If he did it once, he will most likely do it again. And, those co-workers should have been release from their duties as well.

I gotta ask. Is there a difference between propositioning a girl and harrassment? I mean saying banana-nana constantly would be annoying as well, but then being reported and publicly known as a girl-harrasser(forgive the made-up word) for it is unwarranted. Girl shud have said I was annoyed by my boss who would not relent approaching me. THe disgusting thing ofcos is that he did this to a minor. I was harassed at 21 by a man twice my age and I still haven't even mentioned it to my family or friends because I felt like it was somehow my fault and no one would believe me. If she was only 16 when she started working there ,that means she still lived with her parents. And I'm sure if they were any kind of good parents , they asked her how it was going at her job now and then. And being a parent myself, I ask my boys how their day was everyday when they come home from school and I can just about always tell when something is up or wrong. Kids don't hide their feeling very well, so that being said , did she really have these problems at work and why didn't her parents know anything was wrong? they should have known something was wrong after 2 years . And is she just saying this just to get attention ? but , this story doesn't really have this managers side of the story. he could be a low life , or maybe the company fired him because they didn't want all the attention drawn to them. Who knows ? but since she was under age why hasn't it gone to court ?

That was the final straw for Emily" - I know the intention was to express the idea that the initial victim took a stand when the aggressor tried to take advantage of a new victim, due to the arrangement of words it is possible for some people to understand the victim was upset not being the center of attention anymore though, and that can be detrimental to your article. Who in the hell would let themselves be harassed for 2 years. Where are the text messages, where are the witnesses; where is her proof? How was she able to maintain mental stability and get her work done? Not saying he is innocent, but neither is she. She has a duty to call him out after the first advance, report it to human resources. She failed to protect any other woman from the same treatment. I love the way you ladies protect one another with your "bravery."

As a person who has been sexually harassed multiple times over quite some time, it feels rather embarrassing telling others about it. My bosses were absolutely vile at this cafe I worked at. There was no one to report the harassment either. There was no one higher than them, there. This happened over 4 and a half years.

You shouldn't just believe someone just because they are saying it. There is a little thing called innocent until proven guilty. Here is what we know: Emily Houser claims sexual harrasment and gets manager transferred. Manager infroms staff what has happened. Staff throws a Fuck Emily Houser party Emily Houser informs corporate headquarters of this party. Corporate headquarters don't want to deal with a sexual harrasment debacle (which is bad PR) and thus fires Josh Davidson A large number of former coworkers side with Josh. There is clearly something more to this story and everyone should reserve judgement until proof has been supplied. As for now Emily Houser is the prosecutor and thus has to prove a sexual harrasment has happended. Josh Davidson is the defendant and need only to disprove the prosecutors evidence with counter evidence This should happen in a court of law and they should be called nothing more than prosecutor and defendant until a ruling has been made.

ok....but where's the proof though? In this article we only see what happened after the supposed harassment. Why would ALL her coworkers be against her if she was harassed for 2 whole years?! 2 whole years and we don't see a text or even a picture proving anything, all we see is posts from people who've already "closed the case". This seems extremely fishy in my opinion and i find it very uncomfortable seeing most of you play judge and jury without any context at all. For all we know the situation could be the other way around. I don't know what twisted logic makes you feel you have the right to judge people by irrelevant facts but it's the same logic that lead us to the middle fucking ages (hope you've heard of it)...this is absolutely sickening to see in our age!!! I hope this mindless mentality STAYS in america where it was born, no offense to the thinking Americans out there but i'm sure you see it yourselves anyway..................freaking apes man...jeez

I was a married manager of a fast food place ..28 years old..a 16 year old was VERY open in her interest in me...thankfully I only filled in at that location to help and didn't work there daily...but when I explained to her that I was married and she was a child guess what happened?? 3 weeks later I was brought to the main office to explain why I was sexually harassing this " child"

People act as though it is ALWAYS the man at fault. BS. Women (and girls) can be and ARE vicious when they get mad. And they will pay back in ways unimaginable to most of us. Many of you are likely too young to remember the cases back in the 70s of women (remembering) cases of their fathers sexually abusing them. Many men were ruined and or went to prison. These women "recalled" the abuse when under hypnosis, and it turned out that in most cases the abuse never happened. And it wasn't necessarily the fault of the women OR the hypnotists. The hypnotists were simply untrained in how NOT to offer "suggestions" when a subject was under. I get more than a little tired of these "victims" piling on years after the ALLEGED attacks. I am by NO MEANS saying sex abuse doesn't happen. But I have to wonder how many INNOCENT men have their lives ruined by false allegations.

This whole thing is BS, sorry. There's no way a group of her former employees - ESPECIALLY WOMEN AROUND HER SAME AGE - would have a party with that cake unless there was WAY more going on. Everyone who are all ready to boycott Chili's are just having a gut reaction and aren't really using their heads. Do you know what it's like to be a 16 year old female? The women her age are most likely WORSE than the men. You don't know the ages of the staff. They could all be teenagers. Sadly, in my experience, when something like this happens most of the guys stand with the guy that's being accused. Most of the girls follow the guys so they'll stay favorable in their eyes. I agree that there's more to the story. But the fact that he participated in a party dedicated to hating on somebody is enough to be terminated. And I think any employee in attendance should also be fired for bullying.

There is more to this story. It doesn't add up. One, I am a female and there is no way in hell I would let this happen for a whole year or two. Now, maybe some people don't have family or friends to talk too or have help them but, honestly no one will harass me and I let it continue on. Screw that. I'll quit or worst case, fight your ass! This story isn't adding up and for the whole restaurant to #teamjosh.... The question I want to ask is did she have relations with him? Or possibly flirt and lead him on? Some females fail to realize exactly what they're doing and then they cry the... I'm a victim song....maybe I'm insensitive but, honestly the world is a crazy place and both male and females are to blame for a lot of things.

I'm glad you have family and friends who got your back and you would feel comfortable going to with something like this, but, for a lot of us, it's the family or "friends" who are the offenders or we don't feel comfortable going to them, so we just accept it as part of life and deal the best we can, often in silence. Speaking up is scary as hell mostly because of the sort of thing you just said - we may be judged as provoking or just not believed at all.

Especially at work.....he should have been fired years ago from the sound of it. 1. why did it take her a year to report it. Did she accept the gifts he offered? 2. Why did she only report it AFTER HE MOVED ON to another girl. Sounds more like jealousy to me 3. The boss in my opinion is at fault: 1. He's the one who was spreading the sensitive information, he was also an adult when the alleged harassment began (she was only 16), and his conduct during the 2 years, in exploiting the situation, and allowing a celebration geared towards hate, is not only unprofessional, but also disturbing. This to me sounds like one of those cases where "oh she dresses or acts a certain way, so she was asking for it." When in reality, "no" means NO! No clue what the manager's age was, but he sounds like he's emotionally insecure, and gets off on asserting his power. Dangerous recipe. Glad he was fired.

It is actually very ordinary for people to side with scum rather than believe what a woman says about being abused. The staffers that had the "party" were typical. The liked their boss because he was such a pond scum that they felt free to do whatever they wanted, and when he was fired, they blamed the victim. ... What's sickening to me is the women who are accusing her of lying. Why would she lie? Why would she choose to put herself in a position where she would be abused all over again? .... Her situation happens every day - and her employer victimized many kids over the years. I've been fired for refusing to screw my boss, too. This is the way it is. People who accuse women of lying need a firm smack in the chops with a dead salmon.

I had pass by something similar, that wasn't a boss, but my college teacher. I was harassed like other girls at school. My final exams was almost A and B levels except from this teacher. I didn't report him, I was too scared. But I asked help with another teacher and that was my salvation. The other girl from another group fail with him. It is a shame woman instead to stand up for support we are the first one to discriminate or make nasty comments. I know how uncomfortable being harassed and not wish to no one else.

agreed sexual harassment, stalking and the like is never ok. But there's other things that aren't ok, like rushing to judgement and assuming a 18 year olds social media post is 100% accurate. You sound like a religious fanatic, assuming because someone said they know gods plan, it must be true. You see how some people might doubt a person's claim until they know the full story? No one is justifying anything, not one comment I've seen. Most people just have doubts until they know enough to draw a conclusion. A fired manager, from a company that doesn't want to be portrayed in a bad light, and a 18 year old employee that was for some reason hated by what looks like all male and female employees, raises serious doubts about what happened. Don't equate "I don't know enough to judge" with "I support sexual harassment." If you disagree, the next time Jehovah's Witnesses come to your door, don't doubt anything they say, believe them without question like you do teenage Facebook posts.

Assuming you're talking about Mark Klein's Facebook comment, that's not what he said? He said that attractive women generally experience more sexual harassment than unattractive women. I guess you could interpret that as meaning, "It's better to harass unattractive women because they experience less harassment to start with," but that's a real stretch.

I was sexually hassressed for over 12 years and being a single mom I was afraid I would be fired if I reported it. No one knows the mirsery you go through every day and the sickness you feel. I finally married and that didn't stop him. I could hardly stand my husband touching me. It really messed with my sex life at home. I finally quit after 15 years and felt free, but I know in my heart if I had reported him I would have been fired . Please someone find the answers for us women.
